    It seems I might have to go to court over the CCTV and the outcome is far form certain. But there's more, much more.

    This whole affair is now blowing out of all proportion to acombination of a neighbour who at best is an inconsiderate idiot and a local policeforce who are lead swinging incompetent idiots. I know that sounds like apublic order offence of insulting a police man but I have nothing to fearbecause:

    · :mad: The whole affair started with a wrongly grantedplanning application and building regulation dispute. The planning permissionwas effectively reversed as the neighbours could not comply with planningconditions. (Not overlooking our windows and garden.) The Council issued a Stop Notice to ceasework after the neighbour failed to act according to the Council’s wishes.

    · A few months ago I had to tell my neighbour offin no uncertain terms for allowing his builders to route an uncoveredelectricity cable across my patio and other issues like cement being splashedover our widows, patio and garden. When approached the neighbour shouted at me “Idon’t give a !!!!” and a heated argument ensued. The result? I got a harassmentwarning based on a pack of lies & omissions which were all too evident asthere were independent witnesses present. :mad:

    · I made a complaint to the police about thefailure / refusal to investigate. No response after about two months. :mad:

    · The neighbour then instructed a skip to bedangerously overfilled. (i.e. Filled tofive feet over the rim with heavy material.) Ireported that to the police who failed to attend, even though they should havedone so. A complaint was made aboutthat and again the police have not responded even though it is a safety issue. :mad:

    · Yesterday, I reported the CCTV to the police andasked them to come and look. I alsoraised the issue that the police had not responded to the two previouscomplaints. :mad:

    · Today a police man arrived and asked me aboutthe history so I spent an hour going through it chapter and verse. And thisincluded the CCTV camera. At the end of the conversation, the police man stoodup and told he was not there about any of that. He had been instructed bypersons unknown to arrest me for harassment for making harassing phone call andharassing emails.:mad:

    · At this point I discovered there were two policevans outside and six police officers. My pockets were emptied at the front door while it was open and I was thenput in a small cage in the back of the van.:mad:

    · I got to the police station and had to wait halfan hour in an external outhouse resembling a prison cell.:mad:

    · After taking my name and address, they told methey would take DNA and finger prints before any interview or charges. Accordingto the police, this is Home Office instructions.:mad:

    · I was then put in a cell and because I had beenup three hours without anything to eat or drink. I asked for food a drink. I got food more horrible than you would in aKorean concentration camp. Soggy, grey chips and some bean mush in a thick redsauce which I was told was better than the sausage option.:mad:

    · After an hour in the cell, I was told I was freeto go, as I had not harassed my neighbour at all. It was agreed I had sent noemails or made any calls to my neighbours:mad:

    It seems when I reported the issue of the CCTV, some kind oferror occurred that resulted in me being wrongly arrested. The reality is Ihave as many issues with the police as I do with my neighbour.

    I had hoped to have a happy retirement and this is what youget for a life time’s work for queen and country – shabby local government and police services who are certainly not accountable.

    Just to touch on this bit and this bit only of your questions we investigated this when installing CCTV on a commercial premises.

    The ICO office advised on the phone that if it is fixed camera then it is not covered by data protection rules.

    If it can be moved by methods such as automatic tracking, timed movement or remote control then it is a data collection device and fully bound by data protection rules/requires the warning signs that give details of the data controller etc. etc..

    This response is so wrong!!

    All commercial premises with CCTV have to be registered with a nominated point of contact and pay a registration fee. No choice. Doesn't matter whether the camera are static or full function. The system MUST be registered. Residential properties are different. They do not require registration.

    But they still cannot view into someone's property

  • As I have a harassment warning against me I have been warned to talk to them only through a solicitor. Realising this costs money I asked if I could write to their solicitor, at which point the neighbour agreed I could email them, so I did to suggest it is not a good idea to shout "I don't give a !!!! to your neighbours". Response, they confessed to using the expression as I was trespassing !!!

    I am currently enquiring about the planning side, but I have no high hopes as this is Haringey. I have the issue logged with the police, and I doubt they will do much although either.

    After this morning's arrest by error, I have no idea what will happen next ... What I do know is the arresting officer was furious for some dimbo in the police Neighbour Safety Team wrongly instructing him to arrest me and bring me in for questioning.
  • Sending the offending neighbours a letter might just work - but I am not at that stage. Writing to them is a last resort because of the harassment warning. So it is better to contact the police first

    I have found out on a company search, the neighbours have inherited a very large lump sum and a very substantial income along with it. (At least six figures on both counts..). They have also been living in a self contained flat in the rich parent's home. So drivers might be they have little idea how to handle money or people - or they are spoilt brats who have no normal behavioural boundaries.

    I am expecting to hear from solicitors in the next few days about my options vis a vis the police and the neighbour. This could cost a lot of money, although earlier in year I applied for a judicial review over the planning permission. Extremely good value for money, before the hearing there was a lot of willingness to resolve the problem.

    FYI - I had legal advice on this a month and it ain't cheap. So I held off asking for a solicitor at the police station till I saw the evidence of the emails. Pleased I did too - as it turned out the police had no emails and I could have had to pay for a solicitor I did not need. I have told my solicitor what happened today and am expecting a reply from her managing partner.

    On the emails, I would have put it to the police they had to prove where they came from - and I don't need a solicitor to say that for me.

    How naïve is that? I am on the ball here and I hang on to my hard earned money .

    It would appear the OP has a case to claim wrongful arrest.

    I'm sceptical though, too many things don't add up. I can't see a copper sitting through an hour of story telling before making the arrest he came for.

  • If it is wrongful arrest the OP should complain. Aside from anything else it might get he police to act just to stop him suing them.

    You won't get the other side of the story here I am afraid. Let me tell you more about the neighbours.

    They are a young couple mid thirties who both regard themselves as "business people". One we call Paris - short for Paris Hilton. The other's email address is Kronos which should tell you something. Its not to do with time as you might think. The name comes from a Greek titan who castrated his father, then when he learnt he would suffer a similar fate, he ate his children to avoid the problem. But he overlooked the illegitimate child, Zeus, who castrated him and his seed fell in the sea to form bubbling and foam out of which emerged Neptune, Poseidon, Venus, Aphrodite etc... Essentially, someone who is bit nasty, then justifies by saying "Its just business !!!"

    Both have lived in a cosseted apartment inside the parents house - and according to companies house they were given a substantial share of a parent's company which has a substantial value and annual cashflow. ( I am talking 7 figures, millions in value.)

    As far as I can see, neither has much idea how to deal with people or money. They have managed to get everyone's backup within three doors in each direction, even with my lack of diplomacy, I could not manage that - and the neighbour on the other side will probably have to sue for £5K's worth of damage to a conservatory roof. As far as I can tell Kronos and Paris think they can do pretty much what they like - and my guess they have top deck professional advice which is low on the morals front. They have not moved in yet, and when they do, it will be awful for all concerned, even them.

    Current intention is - I will sue the police for compensation if they don't settle which I think is likely to be somewhere between £2K and £8K. That could fund a way to contest the harassment warning and CCTV. However the law on all this is pretty weak. (You can't stop someone complaining to the police even if they are lying or deceiving them in some way. It is their right.) Consequently, I am finding it difficult to get a solicitor willing and able to act. And this might cast some light on it:

    The reluctance of the Law Commission to support the creation of a new tort of harassment is borne out by the following:-
    `We do not think it is appropriate that this jurisdiction .... should be available to resolve issues such as disputes between neighbours, harassment of tenants by landlords or cases of sexual harassment in the workplace. Here there is no domestic or family relationship to justify special remedies or procedures and resort should properly be had to the remedies provided under property and employment law' (Law Com no: 207 para 3.14)

    So the police are going against the view of the Law Commission. And I can see the why the Law Commission thought it was fundamentally wrong - no safeguards.
