So what you're saying is that it could go in and be completely unroad worthy, someone could just look and pass it and that their word is final? Then what is the point of an MOT?0

We see this a lot.
VOSA are NOT a consumer help service.
If you challenge your MOT they will allow you to take the car for a inspection.
If they find the MOT was not correctly issued they cancel it.
You then need a recovery truck to remove your car until it is re-tested at a MOT station.
They do not re-test your car.
They wish you good day and good luck.
They will not inform you of what action they take against the MOT station and the only paper work you leave with is a immediate vehicle prohibition notice.Be happy...;)0 -
No we are saying it goes in passes MOT, then you take it out of the Garage and you may hit a Pothole etc and damage is caused.So what you're saying is that it could go in and be completely unroad worthy, someone could just look and pass it and that their word is final? The MOT just proves at the time of the test the car is road worthy0 -

If you lodge an official complaint to VOSA regarding an MOT that you think was issued when it should not have been, this complaint must be made within 28 days of the test date except for corrosion related problems, in which case you have 3 months.
As your test was about 3 months ago, you have no hope of proving that the car should have failed due to leaking brake cylinders.0 -

I totally agree, but one could have been damaged last week and the other one a couple of months ago.
It does sound very much like you were ripped off by the garage that sold the car, but thinking this and being able to prove it are two entirely different things.0
