Hi there
Hoping you can advise me on this parking fine.
My husband is a blue badge holder. However currently he is suffering from spinal injuries and spasticity etc means that he can't drive so I am the family driver.
Recently I parked in Stockport's Hazel Grove Aldi. We received a notice from Parking Eye claiming that we were parked for 1hr 45 mins and that this exceeded the 1hr 30 free time. I can't recall this specifically but I do recall a day when it took a long time to get round the supermarket and he felt ill afterwards so we sat for a while in the car until his pain had subsided.
I didn't give it a second thought as I wasn't even aware there was a parking charge. We have used this Aldi many times before with no issues.
Should I pay up?

No you shouldn't pay up IMO! If you are in England or Wales you should appeal as no reasonable adjustment under the Equality Act 2010 hasn't been made, if you are on Facebook go to their page and make complaints there. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

If you've got receipts for the day or bank/credit card statements send copies of these with a copy of your husband's blue badge with a covering letter to PE. Blank out any details like account number on the bank/cc statement.
While PE are one of the most aggressive of the parking companies they are also one of the most amenable to cancelling a charge where it is backed up by receipts. Try this, but if it doesn't work we can still help you to get rid of this charge.
Come back on this thread of yours and let us know when you hear anything. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
