packaging

I have a samsung tablet I brought in May from Sainsburys. I have the receipt but no packaging (the original box). It is playing up and not working properly. Can I change it for a new one ?

    Why do you think you are entitled to a new one ? The retailer may offer a repair, refund or exchange whichever is less costly to them, the missing packaging is not relevant but if you have to send it away you need to ensure that it is securely packaged..
  • You don't need the original packaging, just proof of purchase. The Sale of Goods Act says that if the fault is inherent then the retailer has to repair, replace or refund (possibly partial). You can't make the retailer do something that is more expensive than one of the other options.

    If it is less than 6 months since purchase then the fault will be assumed to be inherent unless they can prove otherwise. If it is more than 6 months since purchase then the retailer might require you to prove it is inherent. November is 6 months after May, so you may be just in the 6 Montgomery cut off or just outside it depending on when you bought it.

    If there is a warranty on the tablet then you may also be able to claim under that depending on the terms and conditions of the warranty.

    So contact the retailer and see what they say.

    What do you mean by it's "playing up" if it's just going slow and unresponsive it's not really a fault but usually either a virus or just the system overloaded with too many apps. Running a virus scan (there are free scanners on the play store) and deleting old and unused apps should get it running a bit better or a factory reset will delete everything and you can start afresh with an as new tablet.
