APCOA appeal ignored, fine increased

Hi,

In July my wife parked her car at North Manchester Hospital overnight whilst on duty.

The next morning she had received a PCN from APCOA for £20 and we decided to appeal. APCOA acknowledged the appeal and stated they would respond in 35 days. They did not let us know the outcome of the appeal and so we forgot about it. At the beginning of October they sent us a revised charge notice of £90 with no mention of the appeal. We wrote back (using recorded delivery) with a copy of the original appeal letter and a copy of their acknowledgement of the appeal.

Three weeks have passed and we've heard nothing. We checked on their website and the fine is still showing as £90.

Where do we go from here?

    Just wait for them, they must supply a popla code if they reject
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Its not a fine, email them and demand that they either cancel this outrageous fee with immediate effect or issue a popla code.As their charges are nothing more than un unlawful penalty and that you demand that they (APCOA) give a full apology to you/your wife for the worry that their threatening letters have caused.
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"

    You should report this to the BPA and insist on a POPLA code or cancellation.

    BPA email here, among other info you will need to ensure you WIN at POPLA and don't make the mistake of sending a normal appeal at that stage:

    A very debatable point, the BPA have slackened the line on the 35 days, more of a recommendation now rather than a requirement.

    Even when it was a requirement, it was a very weak argument, there are much stronger ones.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Good news, they have cancelled the PCN due to 'technical reasons' -which probably means they forgot to respond to the original appeal!

    We've seen quite a few of these APCOA fake PCNs cancelled for technical reasons! Nice result.
