Hi all,
Hope some of you excellent people can help me on this and apologize for the spelling i am using my phone at present.
January last year i went to a car dealer close to me to purchase a 04 plate mini cooper. the car was priced at 4995.00. so i opted for finance on the car.
The man in the office was really only interested in one thing tbh and seen the ££££ signs. He was really pushy with this RAC warranty for 3 months and added that to the price. After looking round the car my partner noticed a small oil patch under the engine on the floor we pointed this out he said he would get it fixed.
the finance paper work got sorted and i had to give him a total of £620.00 deposit.
We paid and left as he claimed the car was going to get a service.
2 days later we went to collect the car. The guy basically gave me the keys and and that was it. He mentioned he had giving it a MOT and service gave us paper work and the log book and that was it.
3 months later the passenger side front window wouldn't go down and the car started to play up a little bit. I called round to the garage i got it from as i presumed the RAC warranty would cover it to which i got turned away and the guy was not interested. So i paid it out for it myself as i needed it fixed at a cost of £230.00.
A day later the RAC wrote to me telling me my cover had expired. I called them up to be told by the lady on the phone that THEY WOULD have covered that fix and the man was wrong to tell me that it was not covered. I was now annoyed but took it on the chin and i was not allowed to renew my cover as it had expired on the offer i was giving.
a few months after that the sunroof electrics went, light bulbs kept blowing to much i was spending about 100 a month on bulbs, the window went AGAIN. I have also had to call out green flag out on a few occasions as the car was not starting and was cutting out.
In the last 2 weeks the steering rack has gone in the car i no longer have any steering so the car is just sitting there and also the oil tank is empty as i have a massive oil leak. I have also had the car looked at again by green flag and been told the battery is not charging by the alternator and the alternator itself is on its last legs this is why the car keeps cutting out and bulbs keep blowing. The drivers console warning lights do not light up as the bulbs are going in that.
I contacted the finance company and told them all of this to which they are not happy and have suggested i put a complaint in against the company i got the car off which i have done. I have spend about £1000 in repairs to this car since i have had it 11 months now. The car i cannot move. I still owe 2 years finance on this to make it worse it is due a MOT in January and Road Tax in January. Now as the car cannot move i am unable to to get it MOT'D and if i dont have a MOT i cannot tax it.
The finance company sent me a letter 2 days ago stating they are investigating my complaint however it can take 8-16 weeks for this to get sorted.
in the mean time i am having to continue to pay my insurance, finance etc for a car i cannot now use.
i am not blaming the finance company in the slightest they have been more than helpful. They also cant get there head around why i was charged 620 for a deposit as it should only have been 495.00 deposit.
so my question is this. Whats my best course of action. I cant exactly sell the car as it is not worth what i owe on it. How can i get it Taxed again while this is sorted and whats my best course of action as i want to stay the correct side of the law and not have fines etc coming through my door.

leaving aside what your'e going to do long-term to get this sorted (hopefully the finance company will do their job given time), the tax isn't that hard. Send the existing tax back for a refund near the end of this month and then immediately re-tax it from the start of December (assuming the MOT is still valid for then?).
At least that will mean you can keep it parked on the road while it's sorted rather than having to find somehwhere off road and SORN it.0 -
I have never heard of any finance company exercising clawback on a deal 11 months after it was set up. I think you should get the car off the road, SORN it and set up a small claim against the dealer if you really think the faults were above and beyond what a reasonable consumer would have expected on an eight year old car.
You paid top rate to get the window fixed and less than a year later, it went again? Why not get that repairer to redo for free?
Power steering faults are an unfortunate and recurring quality issue. Just because BMW don't acknowledge it (apart from in the US) doesn't mean it doesn't happen.
Persistent bulbs blowing is something I would have the car in at a sparky straight away. Unless you define that electrical falt and cure it, the car is at risk every day.0 -
Ok i understand what your saying,
The fact of the matter been i was sold a car under false terms it WAS NOT serviced and as not checked prior to sale.
you just need to good the company's name into google and not 1 person leaves a good comment every single comment is repeating the same problems as me
also trading standards are aware of the company and also investigating0 -

Alternators don't last forever, so hardly a "fault". As a previous poster suggested, you should have had the car checked when the bulbs started blowing.
At 9 years old a car is likely to have problems with components wearing out.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -
Personally I wouldn't dream of taking out 3 years finance on an 8 year old car!0

This isn't going to sound helpful but can't understand why people pay 4995.00 for a used Mini with umpteen miles on the clock when there are perfectly good 3-4 year old cars out there with hardly any miles on them. Best bet is to get the car fixed, sell it, cut your losses and buy something sensible with the cash.0

To be honest, thinking about the £££'s is a large part of the salesmans job.
As far as the £620 deposit goes it looks like you paid £495 plus £125 for the warranty.Be Alert..........Britain needs lerts.0 -
I doubt you'll get very far with this one.
Two options:
1. Already stated, fix it sell it and have done with it.
2. Agree with the finance company you're going to sell the car as is and you'll make up the difference. Then list it spares/repairs on eBay and hope it makes a decent amount meaning you'll have to put in less to clear the finance.
Sometimes in life you're going to buy a lemon. When buying any car, Google is your friend. A simple search will show up forums full of common or known issues, Honest John site is great for finding out What's Bad and autotrader is useful for getting an idea on what traders charge vs what they go for on eBay's watched auctions. Every car has known issues. It's up to you to know what they are. Sorry, but that's car ownership today. And yes I fully know it sucks!
Sage council: If it's got t*ts or tyres, it's going to cost you!0
