To pay, or not to pay a default

You are paying money to a third party to speculatively purchased your debt, you have no moral obligation to pay them.
I think that most people would disagree with the above, and say that they most definitely do have a moral obligation to pay their debts. This does not disapppear just because the debt is assigned to someone else.0 -
So having paid £200 and received a letter to say that this was full and final settlement, my credit file is still showing a £107 default and not settled. Grrrr....
Anyone any experience with Activ Capital and updating credit files to show correct information. Any contact numbers would be really useful.
thank you0 -
Hi wellies
Has anything relating to the entry at all changed since you made the payment? If not, it may be the case that the changes have yet to take effect - they are not necessarily instantaneous.
If the entry has been updated but in a way that is not reflective of the settlement that you agreed and paid, then I suggest that you make a formal complaint to Aktiv for starters - only they can amend the entry, not the credit agency themselves. Make it clear that you have written evidence of the conditions they agreed to prior to the settlement payment. Escalation to Financial Ombudsman and Information Commissioner's office if necessary.
Had they referred to marking the debt as "full" or "partially" settled in their letter to you? The latter term tends to be more common where less than the full outstanding balance is settled on.

Hi Dennis, it was agreed it writing that it was full payment. My file has been updated since making payment and shows a balance outstanding of £107. When I called tonight empingham said that it was only activ who could respond to me and the person I needed to talk to had left for the day! I will call again tomorrow and push to speak to someone with some clout!
I just wish these companies would do as they say they will.0 -
Hi again
I'd be airing your grievances in writing as well if I were you. There's a risk that you will continue to get fobbed off if you pursue this purely by phone.

I refer to your recent enquiry concerning the reporting of the above account.
I have updated the entry pertaining to this account to satisfied with all 3 Credit Reference Agencies. Please allow up to 72 hours for this to update on your credit file.
I trust this to be satisfactory and if I can be of any assistance please do not hesitate to contact me.
Above is an email response today which I am happy with. Will be checking that this has been reported and showing on my credit file with 72 hours!0 -
I paid Lowell £33 for full and final settlement in Oct 2013 as I was applying for a mortgage and thought this was the best course of action. On my file it was being reported as a green ? " the lender has not been able to provide the payment history for this month". Since then there have been 3 red markers with the number '8' saying the account is in default.
The original default was 15/7/2009. It is showing as 'Satisfied' default 29/12/2013
This is repeated with Activ Capital for £307. Original default date 21/1/2009. Also showing as satisfied on 12/1/2014
I'm confused, if I had done the wrong thing and not paid I may have been in a better position with no default showing. As a result of payment I now have a default on my file.
Any advice please? Still waiting for the right property but soon to apply for full mortgage; DIP accepted by Halifax.
Many thanks0 -
Considering you wish to apply for a mortgage. Saving a £106 by partially settling a debt doesn't look good on file. Given that you'll be applying to borrow thousands of pounds.
The whole purpose of accurate credit history is to enable the user to make an informed decision as to whether they wish to conduct business. Simple as that.0 -
It is not showing £107 outstanding just a default at the time I paid and marked as satisfied. Why default me at point of paying off the debt? Seems ludicrous. I would've been better off not paying at all...0

You need to get back in touch. The default date is the date you defaulted originally, not when the debt was paid off.
They're either massively incompetent or trying it on. You could phone them but either way I'd write and make it clear if it isn't amended you'll take the issue up with the FOS and the ICO.0
