He is going to get the 25-25 DP from 8/8/2007 and you do get it after a year on IS - a different qualifying criteria for the DP - you can get it immediately with DLA though

The Disability Premium won;t make any difference to HB - he gets the full "eligible" rent as he's on IS.
What might be worthwhile is applying for a discretionary housing payment, which the council can pay to make up the shortfall between what is paid as HB and what the rent is.0 -

The amount of the increase is more than £25.25.
Who does the investigation as to the eligibility of the Disability Premium?
Not all IS claimants get this. I haven't been on IS for more than a year but had DLA prior to leaving work anyway.0 -
Found the details for Disability Premium -
Disability premium
You must be under age 60 and one of the following applies:- <LI type=circle>getting attendance allowance <LI type=circle>
- getting constant attendance allowance as part of industrial injuries disablement benefit or a war pension <LI
- type=circle>getting disability living allowance <LI
- type=circle>getting long-term incapacity benefit. <
- LI type=circle>getting short term incapacity benefit because you are terminally ill <LI type=circle>
- getting an NHS invalid trike <LI type=circle>be registered blind <LI type=circle>getting severe disablement allowance <LI type=circle>getting war pensioners mobility supplement
- <LI type=circle>getting the disability element or severe disability element of working tax credit
- have been incapable of work for 52 weeks. If you are one of a couple the one who satisfies this rule must make the claim for income support.

Is it correct that the Incapacity Benefit for Short-term Higher Rate is from week 28?
From the beginning they paid me £59.20 + £22.24 = £81.44 (£22.24 is Disability Premium Income Support - I have DLA)
If I am reading it correctly from week 28 I went on to the short term higher rate (I am currently on week 39)
My rate should have gone up to £72.55
My Income Support Disability Premium is £25.25
Total should be = £97.80
Please could someone shed some light on this for me?
Is this what I should be paid? Or is there a cap on the figure?
They are paying me £83.95 - since week 28, I think.

Cut n Quirky, it doesn't work quite like that. The disability premium isn't paid on top of other benefits, it's calculated in your applicable amount ie the amount the law says you need to live on. For single people over 25 the current personal allowance is 59.15 and the disability premium 25.25 which totals £84.40. Your IB of 72.55 will be taken off this so you'll be paid Income Support of £11.85 if my calculations are right.
And yes as you ask after 28 weeks the short term higher rate of IB of 72.55 kicks in for the next 24 weeks when the long term rate starts to apply. At that time depending on your age (as this determines the amount of long term IB) you could well lose your IS as your IB might be in excess of your applicable amount.
(The basic rate may be increased in certain circumstances, for example the short term higher rate is increased in the case of the terminally ill).

Yes at current rates that is the amount the law says you need to live on. However as I said your IB will increase after 12 months and could well take it above that level. The rate then will depend on the age you started claiming.
If you have middle or higher rate care component tof DLA then you might be entitled to severe disability premium included in your applicable amount as long as there are no non-dependants living with you and no-one is paid Carers Allowance for looking after you.
