Hi, I have received a C.C.J in my husband name for a business debt on a leased equipment. The C.C.J asking him to pay £22000 plus further interest. I know he had to close his business down about 2 years ago and at the moment I don't think he has a job. I have contacted him via his mobile and have told him that he has a C.C.J, but he has told me there is nothing he can do! Where do I stand, and what can I do with his C.C.J? I am ever so worried that I am going to loose the house. Any advice, help from anybody in a similar position!

The CCJ isnt yours, its for your husband to sort out.
Whose name is the house as that will say if or maybe you lose it ?0 -
Do you just mean it was registered to your address?
I would return the letter to the court and state that the addressee does not live at your address - you might want to tell them of his new address if you know it. At least then he will get a copy of the judgement.
The CCJ is nothing to do with you, and you cannot be made to repay it or be liable for it.
You say you are worried you are going to lose the house - does the house belong just to you?
The sensible thing for him to do would be to either make a rpayment offer at a rate he can afford - or possibly to seek some advice from one of the debt advice charities who will advise him of his options.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Sorry if I have not made it clear. As far as I know he is not working, so he is not in a position to pay the debt.0

The house is in both of our name, but I made him to go to the solicitor about three years ago and have the ratio of our share in the house to 90% mine and 10% his.0

In that case there is a chance that the creditor could apply for a restriction on the property.
That wouldn't mean that you would lose your home or be forced to sell, but it is intended to secure the debt on his share of any equity, so that when the property it sold the debt should be repaid from any equity in his share only.
What are your long term plans regarding the property/debt? I assume you are separated but not divorced?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Was the loan secured against the property?
The fact that he is not currently working does not wipe the debt.No free lunch, and no free laptop0
