POFA query

Hi all,

I seem to remember that there is a deadline for POFA 12? By this I mean that they have X days from the date of the alleged incident for the burden of the 'fine' to fall onto the registered keeper or for the registered keeper to be obliged to name the driver?

Is this correct?

    It has to arrive by day 15 if there was no windscreen ticket, and between day 29 and day 56 if there was a windscreen ticket

    Now I know legislation looks daunting, but you want section 8.5 and 9.5, but read them in context of the whole sections 8 & 9

    Simplistically 14/15 days if no windscreen ticket 28 - 56 days if there was.

    OBLIGED? You are never obliged to name the driver. But if it was a postal PCN and the keeper has left it too late to appeal then naming the driver is recommended as a proactive approach which can be done AT ANY TIME before court procedure. With a postal PCN the driver has never had a ticket until now once they are named with an address for service, so this rewinds the clock and gets a Notice to Driver issued (which the driver then appeals and wins at POPLA).
