Lowell being a nightmare!

Hi guys i have posted a similar thread about this issue but that was a while ago and im unable to find it so sorry for the repeat.

Basically, i had an orange account and kept up the payments. However my friend wanted to take over the contract so i asked orange to do a transfer of ownership. Anyway he ran up a bill and it resulted in a default on my credit file.

Now i rang orange up and explained this and they claim that a transfer of ownership was never requested.

I rang lowell after receiving a default notice around christmas time because the notice said that if i paid i would avoid going into default, so i paid it on 30/12/11.

Anyway Lowell slapped a default on my file and i've been having hassle with them and orange trying to get it sorted.

Here is the information i have on my credit file:

LOWELL PORTFOLIO I LTD
Account Updated to: 30/12/2012

Account Type: Communications
Started: 02/06/2010
Current Balance: Satisfied
Default Date: 08/01/2011
Default Balance: £140

Any suggestions or information would be extremely helpful as speaking to them is getting me no sense at all.

    Is one of the dates wrong?

    You say the default date is Jan 2011, but that you paid Dec 11? Is that right or do you mean you paid in Dec 10?

    Presumably you have proof of payment (copy bank statment showing the debit card payment or something)?

    Assuming you do mean you paid Dec 10 I would write to lowell and simply state that you paid the account on xdate before the date of the default recorded on your file, and that therefore they are obliged to remove the default.

    Do you still have the letter/notice of intention to default from lowell that prompted you to pay? What is that date of that letter? and when does it say you must pay by?

  • sorry, yes i do mean i paid in 2010, and i'm almost positive that it said i would avoid going into default but i no longer have the letter to prove one way or the other.

    As for the bank statement i'm sure if i dig back far enough into my account history i can bring up something or go into one of the branches.

    I would try a letter to start with.

    If that doesn't get you anywhere then you could send a subject access request to lowell (£10) which should get you either a copy of the letter or at least the date it was sent to you (which you can then compare to the date you paid and the date the default was registered on your credit file).
    That would then help with your case and making a formal complaint to lowell.

  • See i have rung them asking for a copy of the letter that i received and any other information but sadly i just get passed from pillar to post.

    Companies like Lowell will lie and try to fob you off on the phone, best to do written complaints.

    When did your friend 1st miss the payments though?

    Account defaulted in January 2011 and you paid it in December 2011, Almost a year after the default had already been registered?

    Did Orange put the default on? Not unknown for Lowell to add their own default at a later date.

    When were the payments missed?

  • Honestly don't know when he missed the payments.

    No orange didn't put the default on, it was lowell, that i am positive of.

    And again honestly am unsure of this because back then as far as i was aware it wasn't my problem, only paid attention to it when it showed up on my credit file again.
