ppi claim upheld but bank not interested!

We have been pursuing a claim with a top high street bank since Sept 2012. In June this year our claim was upheld by the Financial Ombudsman and the bank were given 12 weeks to pay. They have never even contacted us to say how much they will pay us. The Ombudsman then advised us to write to them again and ask for a breakdown of payment, which we did and asked for a reply by return of post. This was 2 weeks ago and still no reply. What do we do now? Even a letter to the CEO by recorded post went unanswered!,

    Or you write them another letter advising them that your complaint has been upheld, you'd liek your money and pelase pay up within a resonable time otherwsie you'll complain about their complaint handling.

  • And remind them that 8% stat interest (if applicable in your case) will continue to accrue until the date of settlement. The longer they take the more they have to pay.
  • Well we've informed BBC Watchdog, and we've given them time to pay, and we've reminded them several times that the longer they take, the more they will owe us! But it's like talking to a brick wall. To whom can we report them apart from the FOS??
  • Who is the bank?

    Was the decision from an Ombudsman or an adjudicator? (They will say in their letter).
  • The bank was the one who has recently split back into two banks....ours was the one with all the initials! The decision was from the Financial Ombudsman.

    It is the Ombudsman you should be chasing as it is their adjudication which the Bank have apparently failed to respond to, not your complaint. You have no power to complain about this delay direct to the Bank. Writing to watchdog will not help either.

    I don't understand why FOS advised you to write to the Bank asking for a "breakdown of payment"? Surely FOS should have done this on your behalf?


    Unfortunately for you, the Bank may have decided to appeal the initial findings of the adjudicator and in this case it will go to an actual Ombudsman for a final decision.

    Do realise that many FOS referrals take eighteen months, as yours has only taken fourteen months (so far) it means you likely have a way to go yet.
  • Yes sadly this proved to be the case, the bank are appealing but didnt trouble to let us know! So we have been going round in circles for months to no avail. Thanks to everyone who posted -I will be back in two years when the appeal has been heard lol! (Gotta keep a sense of humour about these things.......)

    As I said earlier, it is FOS you should be chasing, the Bank won't write to you directly while your complaint is still being considered by the Ombudsman. It is FOS who should keep you abreast of developments. The Bank will only contact you again on this matter if the Ombudsman's final decision goes in your favour and you are correct that it's likely to be some months before you hear anything.
