Disability element of WTC

I found the facts sheet which helps identify if you're eligible for the disability element, but I just can't work it out.

For Table 1, I have an 'other' disability, which is a mental health illness (depression and anxiety). I visit my GP regularly, and have medication from them. My medication was recently doubled in dosage.

For Table 2 a/b - this is where I'm confused. I don't receive any benefits…apart from the WTC I'm claiming for. The only thing I could possibly relate to would be the WTC part. Where it says "I was entitled to the disability element for 56 days before claiming by satisfying the conditions under one of the sicknesses".

I was working full time, until May when I had a breakdown. I was off work for 5 weeks. When I returned to work, I tried working full time but it just wasn't happening. My concentration was bad and I was given a disciplinary for something at work due to concentration. I now work 24 hours per week.

Do I qualify? Any help would be appreciated.

    You have to be in reciept of a disability premium within a qualifying benefit to claim the disability element of WTC.

    That's not correct. You can qualify by that route, but you can qualify in other ways.

    OP - it doesn't look like you qualify. The qualification route you mention is if you have claimed the disability element of WTC at some point in the past.

    Well i was correct then, but just missed some other routes, but it's good to know as i always understood that was the only way so thankyou IQ.
  • I now get the disability element after being off work on ESA. I called and explained that if I was getting ESA then I should get the disability element when I went back to work and they gave it to me.

    Although, I had won an ESA appeal before, this was a new claim.

    If you had claimed ESA while off sick from work (only if your employer doesn't pay SSP) and would be then assessed, it is possible you could have tried for it. But you may well have needed an ESA decision in your favor first.

    If your condition really does affect your ability to work, you would need to be off sick for a while and go through the ESA process...then you might get it.

    It then says you need to meet something on Table 2 a or b. The only one I think I can meet is this one…

    "You were entitled to the disability element of Working Tax Credit in the 56 days before your claim for the disability element by satisfying the qualifying conditions under one of the sickness or disability-related benefits listed in the table above (on pages 4 to 6), or by receiving Disabled Person’s Tax Credit, at some earlier time."

    I phoned them up and they have taken some information and will assess my claim for the disability element.

    You will only get this if you have claimed the disability element of tax credits at some point in the last 56 days. It doesn't sound like you have.
