Newbie and a little apprehensive. NGP,Roxburge

Hi All,

Thought this would be the best place to get the most relevant advice for my situation.

Parked in a disabled bay with my mother in law a few months back, however she forgot her blue badge and therefore I ended up with a ticket! Have ignored all correspondence from them as we were in a private gated apartment site, and had been advised to ignore as NGP are a private company. Have recently started getting letters from Roxburge, and most recently phone calls and answer phone and text messages! (Not sure how they even got my number)

Actually feeling quite harassed by this company, however am not quite sure of my next steps.. have yet to hear from the 'Graham White' solicitors. Was wondering if it's best just to carry on ignoring?

    You won't hear from Graham White as Roxburghe have changed to Gladstones I think. Still just hot air, probably.

    But look at the top thread 'newbies...read this now!' and the acronyms section. In that section I mention debt collectors and give you links and info about robustly responding to tell them to stop harassing you. Send a copy to NGP and to Roxburghe, as per the link you will find (on my thread) to zzzLazyDaisy's thread about robust responses to debt collector letters.

    In your case I would also add that the passenger was disabled (do not admit to forgetting a Blue badge even though in fact it's not applicable on private land as such). Attach a copy of the Blue badge, to the version you send to NGP and say that they must make a reasonable adjustment as in Excel v Greenwood 4th Oct 2013 and cancel this charge because the passenger was entitled to be there and there has been no loss caused.

    Only write as the registered keeper, nothing about 'I parked' 'I went' or what you did. Talk about 'the driver' and 'the passenger' in the third person.

  • Thank you for your reply, I'm wondering if it's just worth ignoring in the hope they will give up? What is the likelihood of this?

    Also, if I do get another letter from a different company what happens then? I'm just wondering at one point I HAVE to respond?

    You should take seriously an 'Lettter before Claim/Letter before Action' and refer to the 'LBCCC fightback' sticky thread near the top, for how to respond.

    We DO NOT RECOMMEND ignoring PPCs as they have got high & mighty since POFA 2012 gave them 'keeper liability' and some are litigious. So please follow the advice given and let us know what responses you get.

    You should also send a complaint and copy of the Blue badge to the Store Manager or landowner/agent that runs the retail/leisure park if there is a store or outlet there. Complain about the harassment and ask if they can step in to cancel this one because it's a breach of the Equality Act 2010 not to make reasonable adjustments for a disabled person who was legitimately allowed to use the disabled bay by virtue of the disability need (not by virtue of the badge) as in Excel v Greenwood 4/10/13. Don't admit to the badge being displayed or not (it doesn't actually mean anything, legally, on private land but PPCs and retailers think it does). Remember to be assertive in your letters; this isn't about excuses or burying your head in the sand and ignoring the intimidation. It's a complaint to all parties, not an appeal, and the Equality Act is the prevailing law.
