  • No not really - you are complaining to the landowner/agent more on the grounds of being mistreated as a regular genuine customer and user of the site - be appalled at the way customers are being hounded for payment of punitive charges for merely daring to park! State also that this will have a negative effect in the end on the leisure park as customers will be driven away by excessive charges and the hassle and demand they instruct Excel to cancel this charge!

    PS> I have googled the street view of the complex and:

    Did you request the photographs of the alleged offence.
    The first and second photographs you posted also do not mention a charge for leaving the sight. - Material information missing and gross misrepresentation. Unfair contract terms.
    The third sign - i bet is obscurred from general view and easily missed - possibly entrapment.

    thanks. yes I did ask for photographic evidence in my appeal.

    OK thanks for pointing out what I should complain about.
    yes I also mentioned what you said about the first 2 signs in my appeal. although the third sign was visible it was outside a nearby tunnel on a wall-not an area it would be reasonable for a driver to look at.

    I'll post a draft of the complaint when I get a chance tomorrow

    Dear Mr Peter Dunlop,
    I am writing to you to express my anger and disgust at the way I’ve been treated after parking in Middlesbrough Leisure Park’s car park. Having parked in a blue bay (which is free for four hours) I went past the job centre to the news agents (a few hundred yards down the road) to purchase some sweets before heading back to watch a film in Cineworld. Upon returning to my car a “Parking Charge Notice” had been issued and stuck onto my window by Excel Parking Services Ltd. The parking charge serial number is “XXXXXXXXX”.
    The charge was issued for ‘leaving the leisure park’ and it is a punitive charge of £100 or £60 for early payment. As a loyal and genuine customer I am disgusted by this charge as it was issued unfairly and I was given no chance to explain what had happened to the attendants who issued the notice. The attendants in fact were very rude and simply fobbed me off stating “if you want to appeal, it tells you how on the back of the ticket” and they then walked away whilst I was still talking to them.
    There is no clearly defined boundary of what is considered to be in or out of the leisure park, and as such it is easy for a genuine customer to be issued this completely unfair parking charge for leaving the undefined area even momentarily. Moreover none of the signs in the car park make any mention of any fine for leaving the undefined leisure park.
    As you can appreciate, customers being hounded in this manner will have a negative impact on commerce for the local businesses that are part of the leisure park complex. Moreover the charges issued are excessive and it is unfair to expect the loyal genuine customers to deal with the hassle of appealing the charge, which is likely to fail regardless.
    As a loyal customer I would appreciate it if you would instruct Excel Parking to immediately cancel this charge, and for confirmation to be sent to me via email to this address.

    This is like reading my own thread haha! The same thing happened to me in the same car park :( it seems you had much more luck than I did finding out the landowner details, Cineworld didn't even bother replying to me! I hope you get this sorted quickly, I'm currently waiting for Excel to decide what they're doing with my soft appeal *rolls eyes*
  • :/ I bet they catch a lot of people with this :p yeah cineworld sent me the details of the land manager (I don't think it's the owner) anyway he replied to my letter by basically saying you left the car park tough !!!! :(

    I'm also waiting on a response from excel. I rang to ask how log it takes and the guy said it can take up to 35 days :(
