New PCN notice - Please help!

Hello,
We received a PCN in early September and after reading through the forums and exploring the web followed the advice then and ignored it.
Letters followed and we ignored them.
When the Letter before County Court Claim arrived we got really worried and went back to the forums to discover that ignoring letters had been the wrong move (arrghhhh!).
So, thanks to advice from LazyDaisy, Coupon-mad, Crabman and more, we have reset the clock by naming me as the driver (the original letters were to my wife).
I have appealed to Parking Eye via the email "appeals@parkingeye.co.uk", which was instantly rejected and via the website appeals form.
Here is the appeal:
Dear Parking Eye,
I wish to appeal your demand for £60 as you have supplied no evidence with your PCN that Parking Eye is indeed responsible for managing the M******** Hotel's car park. If this is indeed the case please can you also supply a breakdown of the £60 charge as this seems punitive, not a realistic calculation of loss.
I am contacting the management of the M******* Hotel to complain at this charge as it seems entirely opposed to the professional, friendly and entirely respectful treatment we received there.
I would expect this charge to be dropped. If you chose to continue this action then along with the evidence requested above I further request your reasons for rejecting my appeal, along with, as you state on your PCN, details of the Independent Appeals Service, their contact details and a unique appeal reference.
Thank you.
Can you offer any further advice? I am expecting a POPLA number next.
Thanks in advance,

Yes try to add this
The amount demanded is not a genuine pre estimate of loss, the signage is not adequate and does not comply with the bpa code of practice. Drop the second paragraph as it is pointless adding it.
And ask for the popla verification code, explain that as all appeals are upheld on the above, so you invite them to cancel this chargeWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Thank you Stroma,
That was quick. I'm not entirely used to all this and foolishly I sent my appeal in and THEN posted this new thread. Sorry, I can't make the sensible changes you suggest.0 -
Was Parking Eye's charge only £60 or was that their reduced offer?
Good that you've re-set the clock for POPLA appeal - here's a useful thread to get you started:
https://forums.moneysavingexpert.com/discussion/4816165
Read some other threads also and the sticky regarding POPLA wins at top of page - work from the back - this should give you a general idea of what to put even though GPEOL or no contract are the main winners.
When you get your POPLA code - put up your draft for checking.
By the way whilst you wait for PE's rejection and POPLA code - do contact the hotel with a stern letter of complaint and request they as landowner instruct that the parking charge be cancelled. (Again sticky thread how to get parking charges cancelled at top may assist)0 -
Thanks 4Consumerrights,
I have contacted the hotel and I got a professional response from the manager apologising for not replying sooner but his mother had died and that he would look at my case after the funeral, which is more than fair enough.
Thanks for posting me towards Guy's Dad's POPLA letter. I do try and use my own language as much as possible but the legalease language is very useful. I've got to say the advice given on these forums is comprehensive, caring and well explained. The issue is finding the up to date and most accurate info.
I seem to find it is there after the fact!!
So I'm now waiting for a response from Parking Eye and a POPLA code. I'll use Guy's Dad's letter as a core piece, focusing on genuine loss and proof of contracts with myself and the owner of the land.
Thanks again.0 -
£60 is the reduced charge.
The "Amount Due" is £100
Guy's Dad's letter from Parking Eye about costs of £53 may be useful!0 -

Stating the obvious maybe (sorry if so) but on any new forum, read the threads on page one/two/three then ask questions if you can't see what you need and if you aren't practised in searching the forum. Never read old advice which you must have done because in September we had already been advising NEVER to ignore these, for six months at least. In September you would have struggled to find any thread saying to ignore a fake PCN here - amazed you managed to find one but at least you are back to appeal stage now and realise that 'we have ways of making POPLA work'!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The thing is, I had no idea how forums worked! I did a google search for Parking Eye parking ticket and read through the first few pages of top hits. There were a fair few MSE forums and even a video of a man on Watchdog making a paper plane out of a PCN!
Now, at last, I've discovered this section of the MSE forums and it is clear and well organised - the Stickies are great - it was just getting here that was the issue!
It would certainly be easier just to pay up but in a world where the powerful constantly screw the little fellas it looks like there may just be a chance here to stick a couple of fingers back up at them, and cost them some money too!
Fingers crossed and thanks for all your help.0 -
And therein is your answer because when you do that you get anything as a result of course. The Watchdog paper aeroplane was from 2010. If ever you find a forum old thread in future, look for the 'breadcrumb trail' of the forum which takes you with one click to the forum board the thread comes from. So in one second you could have hopped to the current threads. So near and yet so far!
Have you discovered the breadcrumb trail here yet? (all forums have one in little blue writing at the top usually). One click as per my signature and you read current threads, not the random one you may be reading.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
