PCN for parking on the curb [code 62]

I received a PCN from Barking and Dagenham for partially parking on the curb.

I believe this was served unfairly for the following reasons:

1) Signage: the sign was small, not facing on coming traffic, and there is only a sign saying you CAN park on the curb, there isn't one saying you CANT (parked car on curb with red line going through it.) The ticket was issued after they'd caught me with some sort of camera / device that monitors the road, however there is no sign advising they have a camera up.

2) My car was not obstructing any pedestrians, including those with a buggy or wheelchair.

What time limit does the pcn have to be sent served in? (e.g. two weeks), the pcn was issued to me 20 days after the 'offence', is it not supposed to be done within 14 days?

Please advise if i can successfully appeal or not, I've parked on that road plenty of times and I've never had a ticket :mad::mad:

  • If this is a council issued ticket you will get much more help on the pepipoo forums - that's their big thing. Scan the ticket and head on over there and follow the relevant instructions to obtain help.

If it isn't and it's from a PPC then let us know...

Was you parked in a marked bay? Thought unless in a bay in london they can do you.also the car that filmed you has signs on it and do lbbd not have signs up randomly saying theyre filming you? I know havering do.
  • truthfully it wasnt, in that particular area i was in, there are roads were people park there car completely on the curb even where there are no marked bays.

I guess im just so used to doing it i forgot about the normal rules

Also as far as im aware there are no signs saying there are cameras or cctv, if there are i wouldn't be surprised if they've put it facing a building or behind a tree

There are points of appeal against CCTv use for PCNs but it's more detailed than just about 'whether there was a sign':

That's an excerpt from a Chief Parking Adjudicator's Report and shows the guidelines that Councils must pay regard to. But take the query to pepipoo as pavement parking ones are hardest to win, seeing as all London Boroughs have a ban on this and they don't need signs about it.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
