Council Tax help!

My partner and i ended a tenancy early and moved to a different address.
We moved our council tax to our new property and told the council that we were moving.
We have now been told we must pay the council tax for the old property for the time the flat was empty, despite already paying for the new property(?) surely this cannot be right?
We were told over the phone that we were not liable for the time we didn't live there, but the council have since sent letters asking for payment as the property was empty. We have today been given a court summons.

The council are correct. You held the right to occupy the property until the end of your tenancy and are responsible for the council tax charge due for this period.
If you are disputing the end date of your tenancy you need to speak to the landlord and get them to confirm the end date with the council.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. Check to see if they offer n exemption on empty properties or a discount to reduce you bill for the period it was unoccupied.These are my own views and you should seek advice from your local Benefits Department or CAB.0
