Part Ex car - Carcraft

Hello,
Firstly id like to say i am aware of my stupidity below and don't need to be told
I purchased a car from carcraft (28/10) on finance, this went over 2 agreements (as oddly.... Black Horse would only cover half, and kindly CarCraft covered the rest with AllInOne Finance).
The first issue is/was that when picking the car up the next day my mam got their first and I was a minute or so later, they brushed over the fact they had already included the 5 Year warranty package(£1995) in the AIO finance agreement. I was very tired and when we got home i worked out two things, the warranty and also the part ex - not to mention the fact they put the V5 in my mams name!
The Part Ex - When we arrived on day 1 we said we would like to part ex a P reg astra and the car I was looking for, they said they need to make sure it drives and then value it etc. I sort of forgot about it but they said they would value it, day 2 when we picked it up they went over the deposit in the agreement (£1700) and I thought class - a decent price.
Turns out this included the £350 deposit, web price discount for the car and a mystery £10. The documents don't mention the part ex price nor the registration or the actuality of it etc, I worked out this £10 must be a goodwill, mistake or something else.
I called up and after humming and harring (the next morning) they admitted it was £10 - i was clearly not happy and gave them the offer of me giving then £10 and me getting the car back (i currently still have the unsigned V5 of it). The finance wifey said they would speak to the manager and drop it off, couldnt be a problem, all sorted, no issues

So, friday comes around and I call them to ask the crack. Im told the message might not have been passed on to my salesman as he is on holiday (Ive only spoken to the finance woman about this and she said I will, I can not He can , He will). She says it will be checked monday morning and she will be in contact. Today i get a phone call from that friendly carcraft number but rather than about the part ex it is about the warrantly cancellation letter i had to send in (i had a load of are you sure, it only costs an arm and one leg), after this I asked about the part ex and all i got was that it was sent off for auction the day after i took it in.
Now I might be stupid here but i called at ~10am 29/10 and she said its not a problem and we wont send it off, you can have it back yet now im told it was taken first thing (either i was lied too or they didnt stop it too hard). They dont know where it went, if its been sold, whether its been sold nor how much it went for.
As of current i have no documents stating I passed this over as part ex or the price they "offered" LOL, I have the V5 with the date and CarCraft stamp on it and possibly a set of the keys.
Where do I stand and what would be the recommended next steps? Ive been advised to contact the police due to the situation backed up with the fact i said dont take it and the agreed to return it.

If your thinking of going and taking the car then don't unless you fancy a few hours in the cells.
You part exchanged your car and left it there. Stamped the V5 with their details. Thats more than enough to put you in the wrong.
They may not have put the discount on it own. If you read all the terrible reviews you already know not to trust them.
Contact the police and say they only gave you £10 for your car? They can easily say no we gave £££ for the part ex but only wrote discount/deposit on the paperwork due to its low value.Censorship Reigns Supreme in Troll City...0 -
They've been doing this trade-in 'scam' for years - I know someone who got caught out in about 2001 with this. I can't offer any advice except to act quickly as you may still be inside any cooling off period (but I doubt it). I hope someone can help you more, they really are an awful company (IMO) and to be avoided at all costs (but you know that now).

So it was only after signing legal documents and parting with your car and cash you decided to read the document and understand the details?
Frankly, irrespective of how it was worked out, if they said you leave your car; you pay £x now; you then pay £x as part of finance and that's what's happening I don't see you have a leg to stand on.
You don't own the car anymore... if they agree to sell it back to you that's another matter, but you'll struggle to prove it.
As for the police, whoever told you they'd be interested is on cloud cuckooland. I once reserved a hoover from Argos and when I got to the store it turned out they had none in store - surprise surprise the police HQ didn't send a team of investigators in to assist me!
I just cannot believe somebody can be so dumb as to not find out what price has been deducted for PE.
As an aside, the V5 isn't proof of ownership.0 -
BTW you probably are still within a cooling off period... so could cancel the finance - the shop though may ask what other form of payment you will be using. Or if they accept cancellation of the order you'd most certainly be liable to them for the use you've had.0

Wow! I'd be reading the Ts&Cs of that very carefully to see if it has any value, what you have to do in order for it to be valid, what they will pay for/not pay for, and whether it is possible to cancel it.

If I read the OP's post right they have already canceleld the finance.
Regarding the V5 with CarShaft, then that doesn't mean they legally own it. Sounds like they haven't actually paid the OP for it (which could be a way to look at it) and have since sold a car they had no title to.
Get on to Trading Standards OP. Start making some noise because it sounds like they are simply hoping you'll go away at this point.What if there was no such thing as a rhetorical question?0
