I have a CCJ - and I knew nothing about it!

Applying for a house and wanted to see what Experian had on me as I know I have debts and it seems I have a CCJ - and I knew nothing about it!!!!!!!!!!!!

My credit rating is showing as 722 - what does that mean?

    Ignore the credit rating. It's a made up number. Get the CCJ sorted.

    How?!?!? The details of the court are on there as is the case number, so would I just get in touch and ask them about it? I don't even know what it's for! It's from Northampton court - and I've never been to Nortampton in my life!!!!

    Yes, contact the court and find out what it is about.

    Northampton is the county court bulk processing centre. Most debt court claims are done through that no matter where you live. If you contest something then it is transferred to your local court.

    Thats correct,its like a mass clearing centre.

    You need to do an application to set aside. That will cost you £80.00. Having not received the claim is a good reason for the set aside, however you need to have a defence that has a realistic prospect of success as well to hand (for the set aside hearing

    first of all who issued the CCJ???

    If the claimant did not court receive paper work AND has a realistic prospect of success with regards to a defence then it is likely a judge will grant a set a side.

    I did not get the court papers

    If you did not get the court papers through the post the court will not always agree that this is a good reason to set aside the judgment. The court is allowed to send the papers to your usual or last known address (even if you have moved). If you have given your creditors your new address then they should contact you there.

    If they still send the papers to your old address then you may have good reason for the judgment to be set aside.

    If you did not get the claim form, you will usually need to show you have a defence or other good reason as well, for the court to set aside the judgment unless:
    • you can prove you gave the creditor your new address;
    • the claim was not made following the rules, for example, they were sent to the wrong address, lost in the post; or
    • the post office returned the claim papers as they were not able to deliver them.

    You'd need something more substantial than merely non receipt of the court papers as a defence.

    You would need at least a good skeleton argument at a set aside hearing as a minimum,

    No, I never received any court papers, and no, I have no idea what the debt is.
