Carphone warehouse mess up = free Ipad. Advice?

Hi All,
Here are the details, let me know what you would do, and if you can, where I stand legally:
I went in to Carphone warehouse on Thursday, bought an Ipad on contract with Three, told it would be active in 72 hours.
On sunday (72 hours later) it was still not connected, so I called Three, they have no record of the number. hmm.
This morning I went into Carphone warehouse, who assured me they had done it all right and Three was to blame.
Went over to Three store, no record, Carphone warehouse must not have done something.
Went back to Carphone warehouse, catagoracally confirm they have done everything, and it is not their problem.
I get back to the office and call Carphone warehouse and they say oh, that number is registered to a Blackberry, not an Ipad, the store need to sort it, go back to the store and get them to return and reissue.
So I go back to Carphone warehouse store, they say okay, they will "virtually" put it back in to stock, then sell it to me again with a new sim - job done....
I get a refund of the initial payment, they cancel the agreement and I get a certificate saying so.
Then he tries to reissue me the ipad, says it wont work and he needs to wait for head office approval, he will call me.
An hour later he calls me, ah, problem, he can't re-issue the Ipad to me for between 2 - 7 days, could I please bring the ipad back as soon as possible, as if not he is dead as shouldn't have done what he did.
The ipad is 240 miles away at home and I am not going back until the weekend, so cant return until at least Monday and I went crazy buying apps on the weekend, spent around £40 on them, so not too keen to return without replacement.
Result?
I have a new Ipad air, my initial payment has been refunded and my contract cancelled.
Where do I stand!
1.) how would they force me to give it back? Is it theft, or breach of contract on my behalf?
2.) What would you do?
I know the ipad is not mine, I have not paid for it, but I want to know what happens next and what you guys would do!

As you would be looking at permanently depriving the true owner (CPW as they refunded you) of an asset then it would be classed as theft.
Number 2 is tantamount to blackmail btw.
Why don't you just insist they wait until such time as they can rebook the ipad?0 -

The fact you have bought apps is irrelevant. You can download purchased apps on any apple product you register you App Store account onto.
People make mistakes, say this guy lost his job and as a result his home, at this time of year?
