New home warranty for water leak

Dear website users, I would be most grateful for your advice.
I bought a new Charles church home on the 20/7/2012.
Just a month ago I noticed a big water leak in a room downstairs.
I called the builder and they sent a plumber. According to him the problem was with a small pipe not properly soldered together l, which was replaced. I have then noticed the week after the repair a big leak on the ceiling. Inspecting carefully the boiler cupboard, I noticed water dripping from a small tank above it. Plumber came again and said I need two parts replaced. I called the plumber who installed the system within a year of moving in for annual maintenance. They did not turn up and I ended up going with British gas whose engineer carried out the maintenance at the beginning of September.
The plumbing company says it is my fault and I have to pay for the repair because I was a month later in doing the maintenance.
In the meantime I also noticed that further leaks appeared on the ceilings and that the big boiler seems leaking as well.
What are my right? Can I enforce the builder to put things right as they are suppose to provide 2 years warranty?

  • I know this rely comes late but....you would have been told that the boiler must serviced every 12 months and failure to do so may invalidate the warranty. I don't think you can really enforce the warranty when you failed to do the service: even if the first plumber didn't turn up, there are hunderds of registered engineers out there, so you didn't need to go two months over. I wish more people would understand the need to service the equipment in a timely fashion not just for safety, but also for this exact reason. One of our neighbours is having the same issue at the moment and expects us to 'be on their side'....
