Hit by uninsured driver

    do you know *why* the car rolled?

    failure to set handbrake is obviously negligent, unexpected mechanical failure or third party involvement wouldn't be so the owner might not be liable
  • It also sounds like he may be trying to get his business to pay for the repair out of pretax profits when he should be paying it after tax. That would be fraud.

    Are you 100% sure about this? If it’s true there is no way I’m going to agree for the invoice to be issued to his business.
    I have to say that now he doesn’t even want to deal with me personally and asked his Chief Operating Officer, Accountant and In-house Lawyer to take care of this on his behalf!

    No I haven’t. But will definitely do if I decide to go through the MIB route.
    So, the car is parked, possibly off the public highway, but rolls from a parked position, into the op. Not attended, not negligent, unless the owner was sitting in the car, and a seriously bad parker? And he's offered to pay. And the advice is to refuse his offer? So, who pays if he doesn't? And what offense can we have him for? As the op hasn't confirmed he was actually in the car, and the car was initially parked on a public highway?

    He was parked just off the main road on a driveway but before the entrance to his business premises. I’m not sure if that still counts as a public road or not. I don’t know where he was when his car started to roll but when I saw him (he was shouting) he was running beside it, trying to stop it. I’m sure he didn’t pull the handbrake but I have no proof for that.

    So no proof he was ever driving it, if not on the public highway police wont be intrested.

    He will want a business invoice just for vat purposes, ask the firm for you details on the reference
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
  • He'll want to claim VAT back from the invoice, that's all.

    I'm pretty sure if anyone had the opportunity to claim any VAT back they would to unless of course you enjoy giving money away.

    Its his business and his money ? What's the problem with what account it comes from?

    OP you can just have a copy of the invoice for your records and I'm sure if you explain to the garage they will honour any warranty.

    When you do a MID search it asks you for the date of incident, so it will reveal the details of the insurer associated with the vehicle for the actual date specified, not the date the search is done.

    Think about it.

    He can afford to pay for these people but not to insure his car. I smell a rat!
