Family member living in property, supposed to be buying it, 18m on, going nowhere?!

    My mistake, I misread it. I thought you meant they had paid you some money to cover the interest, after you'd reminded them. You didn't mean that at all.

    Who paid the £25k? If them where did the money come from if their reason for not obtaining a mortgage is because of a lack of sufficient deposit? Personally I think they have done this on purpose knowing that by putting this money unto the property you would be reluctant/could price difficult to get them out and they are now sitting pretty.

    I'm nagging, but politely, in the end from June I ask for interest on mortgage to be covered. I'm expecting a baby & really can't afford to lose £300 month interest!!

    If you have ever accepted any money from them to cover the interest on the mortgage, they are tenants by law (assuming England and Wales).

    Does not matter what you think they are, that is how you have to deal with it now.

    Why aren't they paying rent until they have a mortgage? If they had a mortgage they would be paying out, and you would be renting the flat out or selling to someone else if they weren't there, so why aren't they paying anything? As you are paying a mortgage on the property and they are living in it, you are subsidising them. I can't see any reason why you should.

    There should be no need for any sort of fallout by raising the need for them to pay rent to stay. All you need to do is point out that you cannot afford to continue letting them stay for nothing and offer them the choice of paying rent or buying now (but paying rent until the money comes through). I realise they have been refused mortgages, but that's not your problem and to be honest there is perhaps little incentive to try for one as things stand! After all, why pay a mortgage when you can live in the same place for nothing?

    I was about to add more, based on the renovations, but it's not completely clear whether you or your BF's brother paid for them. That obviously makes a big difference!

  • I have received less than £1000 over 18months.

    I never intended it to be long term, a month, maybe 2 while mortgage was sorted to help out a friends and a family member.

    I haven't paid for any of the work being done. That I believe has been done on loans/finance/other family help!!

    I don't understand how it has gone on so long, and I do not know what to do. Our Christmas will be rubbish as no money, our holiday early next year is looking impossible.

    I have just tried to be a kind person, and help out, and I feel like I have been robbed, beaten & left at the side of the road :-(
    I'm getting older, and lifes getting harder!:mad:

    OP, I'm afraid in legal terms they are your tenants as they have paid you rent and you accepted it, it doesn't matter how much or little it was.

    Back to the original matter. You need to have a proper talk with them and give them an ultimatum, as advised in LannieDuck's post.

    My BIL then said he wanted to buy it, we agreed a price, and he said he wanted to renovate it before moving in. Which I was fine with as it was on the bad side of shabby.

    This was your first mistake! Never do anything like this without having a written agreement.

    Work began in Oct/Nov 12, him & wife move in in Jan 13.
    £25k spent on complete remodelling!

    So has their £25k actually increased the value of your property? Has the work been well done?

    I wouldn't be surprised if they don't claim that they were doing the work in lieu of rent.

    You need legal advice and, if your BF isn't supporting you 100% in getting your property back from his relatives, you need to seriously consider whether to stay together.
