Stolen parcel, rights?
Toxicity

Purchased an outfit from an online clothing store for an event this weekend. Courier attempted to deliver package while I was at work and when I returned home there was a card stating it had been left 'around back on top of bin' needless to say there was no parcel there by the time I got home and went to find it.
The company have apparently spoken to the driver and he confirms nobody was home and he simply left the package in an insecure location however the retailer are stating that because I did not leave specific delivery instructions they cannot refund me and I must decide between a replacement order being sent (useless to me now as they can't get it to me in time) or store credit.
Am I not entitled to a refund?

Take replacement and then reject under DSR?0

What they have told you is silly. They have failed to deliver so are in breach of contract. As already suggested you can cancel the order under the Distance Selling Regulations, although you don't need to get them to send a replacement to do that. Send a letter or email telling them you are cancelling and want a full refund.0

Thanks for the replies. I have emailed them again mentioning breach of contracts, DSR's and asked for a refund again. Hopefully that'll work!0

Ludicrous response from the company. Who was the courier out of interest?0

I believe Hollydays was asking which company was ordered from rather than which courier?0
