Am i likely to get it back or have i been ripped off? What would you do?

Long story but i'll try to state the facts. Had a horrific car accident in august, breaking my collarbone, surgery to fix and wrote my car off.

Pay out from insurance was £900 (i was in my last year of finance with Toyota so they needed paying off).

Managed to scrap together £3,000 for a new car. Bought a used Toyota from a small time local dealer (what a mistake?!).

Purchased nearly 3 weeks ago. Car has been back with them since last monday with a 'fuelling problem' - basically the car kept losing power since day 2 of purchase!

Car is still with them. Ive been fobbed off with 'just give me one more day to diagnose the problem'. Everything else has been ruled out, apart from the fuel injectors.

Spoke to him last thursday. He said injectors needed to be sent off to be tested and we would have an answer by monday. Monday came, no call. My husband rang to be told he wasn't actually in but the car wasn't back yet. No answer as to whether it had been confirmed to be the fuel injectors or not.

Rang yesterday to be told he was out but was due back. Left a message for him to call back. He didn't.
Trying to ring him again today, juggling a poorly toddler and a dog recovering from an operation.

It must be said at this point that my little girl's brand new car seat is in the vehicle and he wont actually reveal the location of the car! He will go and get the car seat for me, but wont actually tell me where the car is! Very strange!

Spoke to trading standards who say that the law states 'you need to give him reasonable time to repair it'. Well he's had it since last monday so i think reasonable time has been given.

Its such an inconvenience to me. Its actually cost me money in taxi fares etc during this week and indeed last week!

I don't think i have a cat in hells chance of getting my money back off him. He's very cocky and quite intimidating! When i mentioned contacting trading standards to find out my rights, he actually laughed down the phone and said they wont do anything because i am getting it fixed for you!

This has been more stressful than the actual crash and the surgery that followed! What would you do? Any advice greatly appreciated because i don't know what to do next. Im due back to work in 2 weeks time, will i have the car back by then? If not, I'm going to end up at a Toyota dealership (where i should have gone in the first place!) and sign a finance agreement! Gggrrrrr. Many thanks x

    I would stand outside the dealer on his busiest day with a largesign saying "I am unable to move from this spot because the car this guy sold me broke down within two days and he has had it for.....days now and cannot fix it or give me my money back".

    Give him a deadline - tell him otherwise you will collect the car as it is and have it repaired elsewhere and pursue him for the costs. He can't really deny giving the car back to you and certainly won't like what you plan on doing.

    I can understand your concern and, from what you've said, there are things in his behaviour that certainly sound worrying. But, honestly, a week and a half may not be a reasonable time to diagnose and fix a fuelling problem on a modern car - especially if the problem was intermittent and / or hasn't been picked up by the on-board diagnostics.

    That said, if it's proving difficult to pin the problem down, then it would be reasonable for him to be keeping you informed about what's happening rather than leaving you to (unsuccessfully) chase him!

    It was the 4 fuel injectors that would need to be replaced and therefore the garage have decided it would be too expensive to repair and we have therefore received our money back :)

    Glad you got the result you wanted. And, in the end, the dealer appears to have treated you fairly.
