brand new phone bought on ebay

I bought a HTC one mini for £250 about 6 weeks ago on eBay. It had been working perfectly up until the weekend.
The first problem I noticed was that the phone was acting as though it was still charging even when I disconnected it from the charger.
Secondly it wouldn't switch off. I restarted the phone and didn't charge it until the next day.
It didn't charge again and the red charge light kept flashing. Now it doesn't charge at all or switch off and doesn't recognise being linked to my laptop.
Like I said it worked perfectly up until sunday.
I've contacted the seller to explain the situation but I've had no response.
Its still under warranty as it states its 24 months from purchase. The only problem being that in the small print it says the only person eligible for the warranty is the initial owner/buyer of the phone, unless HTC have written proof of a private sale/transfer of phone to new owner.
Do I have any rights in this situation?
If the guy I bought it from hadn't registered his details with HTC then in theory they wouldn't know he previously owned it and I could use it??
Please advise, I don't want to have lost £250 on this

Yeah didn't do anything. Now its completely dead and won't charge at all.0

You ask if you have any rights.
As a manufacturer's warranty is in addition to your statutory rights, the manufacturer can specify any reasonable conditions he likes.
So unless you can get whoever sold the thing to you to produce the required documentation, a resolution under the warranty will be only happen if HTC offer a goodwill gesture.
Is the seller a business or a private individual?
If the seller is not a business, then he only has to describe the goods accurately.
It appears he did that as it has worked for some time.
Generally, you get no after sales service from a private seller.
Have you looked at ebay/paypal buyer protection?
I believe it's 45 days limit, so around six weeks.0
