Section 75 refund - business transaction

Hi

I paid for some advertising over 6 months ago (cards to be displayed in Tesco store) - many promises later this has not happened.

Although a business transaction, I paid using a personal VISA card.

Could I claim under section 75?

Section 75 is a section of the Consumer Credit Act.

However, you can try chargeback that is a VISA procedure: Visa, Mastercard & Amex Chargeback Protection

May not be possible, as the OP is almost certainly outside the 120 day time limit (if the advertising was to be provided within 2 months of the transaction date)...

Maybe, but IIRC 120 days is from the expected delivery date. Don't know how this works if the date, say, gets moved forward.

Well... yes. But the name of an Act isn't used in its interpretation.

The issue with S75 here is that it only works when the cardholder is in contract with the merchant. If the OP is self-employed, then I believe the OP should be OK. But if the advertising was for a limited company, then this is a separate legal person from the OP and S75 wouldn't be available.

That exemption relates to agreements taken out mainly for business, not a particular transaction. So the CCA74 wouldn't regulate, for example, a business credit card.
