G24 invoice

I received a Parking Charge Notice today (4th Nov) from G24 for an offence on the 16th October. their issue date on their letter is the 31st October. by my reckoning this is 15 days after the offence. Can I tell them to cancel the invoice on this alone (14 day rule) or should I go through the process of writing to the store where we parked and to G24 to appeal the charge.

    They can no longer chase you as keeper and you can refuse to give up the driver. I would respond in that vein. Others will give you BP and DVLA email addresses to complain to.

    If you get the appeal rejected and the onsite Store Manager is unhelpful (as well as the CEO and/or the retail park agents, complain there too if applicable) then you will win at POPLA appeal stage with our help anyway.

    Here we go guys. I've drawn up an email to send to G24. If you could cast your expert eyes over it I would be really grateful.


    'The driver was a patron of the B&M store and attached is a copy of a bank statement to prove items were purchased in the store on the date in question. Also as the registered keeper I can tell you that you have failed to serve this Notice to Keeper to me within 14 days as the incident was on the 16th of October 2013 and your parking charge notice was issued on the 31st October 2013, even if it was posted on the 31st October it could not possibly have arrived within 14 days of the incident I have kept the envelope and have a witness to the fact this arrived too late for registered keeper liability.

    Further to the above, please explain fully on which of the following grounds your claim is based: trespass, breach of contract or contractually-agreed sum. Please note that if you are claiming that trespass was committed, I would like to receive a full breakdown of the actual loss suffered by your business or the landowner which could give rise to your claim for damages, as no damage was caused to the car park and the car park was at less than 50% full on the day in question. If on the other hand you are claiming there was a breach of contract or a contractually-agreed sum, I would like to receive a copy of the contract which the driver allegedly entered into.

    I will not be naming the driver and you have suffered no loss so you have no case. I expect this to be cancelled and if not I will complain to the B&M store manager together with letters of complaint to BPA and DVLA, and will expect a POPLA code from you so I can take the appeal further.

    I would add that it must be delivered to keeper within 14 days, not when it is sent. Given that October 31 was a Thursday, by POFA rules the earliest it would be deemed served is 4th Novermber to allow for 1 working days delivery.

    I know you know that, you need to let them know that too quite forcibly. You also haven't actually said that because of the late delivery, then can not transfer liability on to the keeper.

    Think it was delivered on the 4th November. Would this mean I would have to give them details of the driver. It is well over the 14 days I think. But this is all a minefield to me, but there's no way I want to pay £90

    I'll just have to wait for the POPLA code if they think they have a case.

    No. I phrased it badly. I meant that they could not have delivered it before 4th November by POFA rules and that is out of time. Sorry for confusion.
