Hi guys
My fianc!e has had several phone calls and letters from 3 network re unpaid telephone account with them. He hasn't got a contract with them and never has and we've found that there is an entry on his credit file for 3 with an address that he has never lived at. 3 have now sent the unpaid debt onto a debt collection agency and now they are hounding him re this. He has contacted the credit agency and they have contacted 3 re this and they have to get approval from them before they can move it from his file.
3 are not willing to move on this and he is at his wits end regarding all of this - he is getting phone calls and letters regularly regarding this debt that is not his.
Can anyone provide any advice on this?

Is it 3 writing to him or a debt collection agency?
Has he responded to the letters at all?
Hopefully the investigation by the credit ref agency will get things sorted but he might also want to contact them direct himself - so he could send them the prove it letter to start to say he has no knowledge of the debt - Letter when you know nothing about about the debt - AKA "Prove it" letterA smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Write to both the debt collection agency and 3. Ask them for a copy of any signed agreements which he has signed up to and all copies of the accounts, when created and statements.
Next if this clearly is not you and you are able to prove it, write back to the debt collection agency stating OFT guidelines for debt collecting. They must take all reasonable care to ensure you are the correct person.
If you have been the victim of ID theft it may be better to report this to the police0 -
yes he has been on the phone to them and they are hopeless they are saying its definitely him and he owe them the money. they have passed on his details to a debt collection agency now and now they have been on the phone and lettered him re this. He has contacted Action Fraud who have registered it but despite this he keeps getting letters and phone calls from the collection agency. He has now registered it with the Ombudsman who have said that he needs to wait until he has a "deadlock" letter from 3.
He has since had another couple of phonecalls from other companies saying that he owes them money which obviously suggests that someone somewhere has opened a few accounts in his name and now the companies are requesting payment. These companies are doing investigations and seem to be better to deal with than 3 network. As you can imagine, its causing him lots of stress.

No point at all in him calling them by telephone. He should write to them to dispute the debt.
Sounds like it would be worth him getting copies of his credit files to see if there is any record of this or other debts that he does not recognise.
When any new debt collector calls it is best to say that he won't discuss anything on the phone and to ask them to write to him with details of the alleged debt.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
