See the links under the POPLA acronym on my sticky thread 'newbies, read this now!'. Show us the draft you then put together.

As for their claim it's not 'damages for breach', how come the actual Notice to Keeper states the charge is for 'breach'!! :rotfl:
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Appeal gone off to POPLA. How long do they take to come back?
  • They give you a guide date on their acceptance email.

Did you get your appeal checked here first ?
  • Ah yes 23rd Jan.

For the appeal I used a lot of the stuff off here so pretty sure its all good.
  • Good news. Appeal upheld. Heres the text:-

"The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
Accordingly I have no option but to allow the appeal."

Sounds like they didn't even bother to send any of the stuff in which is weird.

Do I need to know contract the Operator to confirm cancellation of the charge?

Perhaps I'll send them an invoice for wasting my time... :-)

No you don't contact them - they have to contact you to confirm the PCN is cancelled.

Feel free to issue them a Personal Costs Notification ... it has been done before. :)

    Well
You issue an invoice to the parking company. giving them a certain amount of time to pay

If they dont pay you then issue a letter before claim and if needed a court claim

Someone did it successfully against NGP on Pepipoo

Here are the details from The Parking Prankster's blog.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
