Bank Charges Notice?

About 3-4 weeks ago I gave a company a cheque for £55, I expected them to take it within 1-2 weeks. I had the money in my account at that time. I wrongly assumed they had taken the money from my account. So carried on spending the money in my account until it had gone.
I then checked my account balance last week and it said -£53, I thought what the hell, I can't go over drawn on my account.
I then checked again the next day and it said +£20. Once again I thought what the hell, Where has this £20 come from. I know I was due to have £60 paid into my account so why is there only £20. The next day I had a letter from my bank saying that they couldn't pay the £55 cheque and that they had taken a £38 charge for this(by this time the £60 had been paid into my account so that's how I ended up with £20 in my account)
I'm not really worried about the charge although it does seem abit steep, What I'm concerned about is can they just take the charge like they did without giving me notice?
If they wouldn't have took the charge straight away I would have £60 in my account so I could pay this company there £55 and then arranged to pay in the £38 charge.
However now I'm left with £20 in my account and this company hasn't been paid and I don't get paid for another week and this company needs the £55 deposit as a direct debit of £50 a month will start on July 1st which can't be changed.
I bank with Nat West by the way.

Payable when a cheque, Standing Order or Direct Debit is not paid due to there being insufficient funds available in your account
When charged
Unpaid fees are applied at the time the transaction is not paid or taken from your account
