Any Housing Benefit Experts?

Hi, is there anyone that would know the answer to my relatives question? Her son works and lives in a large private rented house she lives in another private rented house with her husband but they don't work as he is on esa and dla and she gets care allowance so they get full housing benefit, they plan to move in with their son and they think they can housing benefit for the room they would use. I am not so sure that they can do this as I don`t think h/b would pay for their room as its their son. Can some one say who is right? Thanks

    Not sure I understand the situation.

    If their son rents a house (ie is the tenant) are his parents moving into the same house and becoming tenants as well or is it some other situation?
  • The son rents the house but has 2 spare rooms so if they move in as a couple they would only need one room. They think they can claim h/b for that room and this would pay towards the rent. I am not sure they can do this.

    are they going to be added to the tenancy or just subletting from their son?
  • just subletting from the son, his landlord is his friend apparently and they have asked if the parents can move in and he has no objections.

    If the parents sublet from the son then HB won't be paid as the landlord is classed as a close relative and they would be living together in the same house. There are no ifs or buts it just won't be paid. Local Authorities are prevented by law from paying HB where close relatives are living together in the same household.

    If the parents are added to the tenancy agreement then they can claim HB as the landlord won't be a close relative.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

  • There is nothing stopping them becoming sub tenants - just that they will receive no HB.

    They will receive HB if they become joint tenants - or even the tenant.

    hi im not sure if im on the right thread but here goes can anyone HELP with this question please.my husband and me live in a private rented house we get LHA rate for one bedroom [£69 per week] however my brother is going to move in with us [we have a 3 bedroom house] his move will only be for 3 months we are all disabled and on esa and dla how would my housing benefit and council tax [whickhwe pay £90 per year] be effected
