Do I have to accept that I am out of pocket?

Hi there,
I'm really hoping someone might be able to shed a bit of light/point me in the right direction with this.
I bought a gaming headset about 2 years ago from an online retailer. Within the first year the right ear cup stopped working. I went back to the retailer to report the issue but they passed me off to the manufacturer who were happy to replace the broken headset and did so.
They had to replace my headset with a different model as they were no longer making the one I had originally bought. Now, however I have the exact same issue with the headset they gave me as a replacement.
I have since gone back to the manufacturer to tell them but this time they have said they won't replace it as the original headset was out of warranty on the 16th Oct 2013. It doesn't really make sense to me why that is relevant and I am not sure what to do as I don't have a useable headset yet they have my money...
Any advice or guidance would be greatly appreciated.
Thanks
Laura

it is relevant as the warranty for the original one carries over to the replacement, you dont get a new warranty with the replacement. the manufacturer does not have your money, the retailer had your money 2 years ago, you are out of warranty, so what do you want. Are you after an unlimited warranty0

It's relevant because things don't last forever.
You have had 2 years out of it, if you want more it's now up to you to get report from an expert to state the headset suffered an inherent fault through no fault of your own. Present that to them and if they agree they should remedy the problem, including the cost of the report.
In reality you have had 2 years, time to buy another headset, even if they were to refund you it only needs to be partial to take into account the 2 years use you have had from it.
Another thing to note is that the manufacturer doesn't need to do anything, any resolution needs to come from the retailer you purchased it from, this is who is responsible for it if there is a SOGA issue.0 -
Well thanks for correcting me but can you actually offer any advice please?0

But that's just it, I haven't had two years out of it, I've had less than a year out of both. It's relevant because things don't last forever.

Not at all I'm just after something that works for a reasonable amount of time without packing up?earthstorm wrote: »it is relevant as the warranty for the original one carries over to the replacement, you dont get a new warranty with the replacement. the manufacturer does not have your money, the retailer had your money 2 years ago, you are out of warranty, so what do you want. Yes but Bris was implying that I had 2 years out of the headset, which in fairness if I had I wouldn't question it and would have just bought a new one.0
