Meher you are wrong, that is all
  • who's Wayne Rooney?
  • Tell him that you will pass his claim on to your insurer, which is what you can do for any claim from a neighbour. You are covered under the personal liability section of your house contents policy if damage was caused by your negligence. If they refuse the claim because you weren't negligent, tell him to claim on his own insurance (if he has a policy that covers accidental damage).

. Children play with their toys and footballs and kites and many other gadgets and they may land on their neighbours garden - Normal. The neighbors dogs destroying it beyond recognition, neighbour refusing to address their grievance, arrogantly responding and aggravating their feelings - Abnormal.

    or perhaps:

Neighbour offering to replace the unsigned ball even though the garden was well secured with large fences - Normal

Child and parent not taking ANY responsibility for what happened and threatening court action - Abnormal
  • THE DOG OWNER MUST PAY FOR A NEW SIGNED BALL
Its just typical of moron dog owners who don't take responsibility for the damage caused by their dogs. In this case the pack of wild dogs were allowed to roam around the house and garden while the owner was not at home. What if the young boy next door had got a chair or step ladder and climbed over the fence to get his ball and the pack of dogs had attacked him, would the dog owner still not be responsible? I'm amazed that on this day when I hear in the news about another fatality due to dangerous dogs, that nobody else blames the dog owner.
  • They would have to prove the ball was destroyed out of malice to have a case. I can't see how they would do that unless they can prove the dogs supported a rival club.
As a Liverpool fan I would have thought having Rooney scribble on your ball would make it less valuable, surely ?
How can they prove it was Rooney who signed it anyway - i mean, one 'X' looks the same as any other.
    OK, enough Rooney gags :)
Seriously - your dogs were securely on your property so I can't see how you have a case to answer.

Out of interest, what if a smaller dog/puppy was seriously injured by the flying ball? Who would people think at fault then?

It does sound like the dog owner took sensible precautions (high secure fence). The ball could've been damaged easily just by normal dog playing - puncturing and licking off the signature! So I don't think any training or lack thereof is the issue here.
  • Your dogs are contained securely in your back garden via a 6ft fence and the neighbours child kicks a ball over it.
If i where to throw a valuable painting over the fence or a leather coat and the dogs damaged it,who'se fault is it?
Once it lands on your turf then you can do your best to give it back, but the thing is you weren't there. It's tough luck on your neighbours part, plus i would ask to see the documentation proving it was signed by wayne and why was it being kicked around the back garden? As for the threatening neighbour, ignore him/her and phone the police.Just another one of lifes scams i'm afraid,do not pay anything as you are not at fault.

What if the ball ruined your prize Azalea & rare blueberry bush when it was kicked over - counter sue for the damage (& I have an 8 year old who is forever kicking balls into neighbours' gardens & having to grovel to get them back!)

I'm absolutely astonished at the people saying it's the dog owners fault as their dogs are "badly behaved".My dogs are out in the garden all day, and if a ball came flying over the fence it wouldn't last long, they are given balls as toys, and can't tell the difference between their balls and someone else's.

If someone climbed into my garden, I am 100% sure the dogs would be happy to see them and lick them, however if a child of mine climbed into someone else's secure garden and was bitten by a dog it would be the child's fault, not the dogs.

If someone threw a steak into my garden it would not last long either!

Definite no to ball replacement, they can claim on their house insurance if it was that valuable.
