Redundancy and company car

Dear All,

Part of my compromise agreement was the use of the company car for a month. I signed it off for pay, tax etc which was my main worry. But now the car is to be returned and ive only just seen in the small print that i have to return the car to the head office in leeds from colchester, i really cant afford the travel costs. With work threatening with the police for thief if i do not return it. How do i stand to say they can pick it up.

    Surely it will depend on what was agreed in the compromise documentation.

    I had a similar problem a couple of years ago. As the CA did not specifically say that I had to return it, only that the company granted me use of it for 3 months, then when the time came I refused to deliver it to them. I told them by email, so it was in writing, that I was not refusing to hand back the car or obstructing them taking possession of it just that I was not going to personally deliver it to them (I also raised the question of would I be covered by their insurance while driving it to them). I told them they were welcome to come and collect it at a mutually convenient time, or if they'd prefer I could park it on the public road and hide the keys under the wheel arch so they could get it anytime. They collected it 2 hours later !

    Put it all in writing so that you have proof that you are not refusing to hand it back just in case plod do get involved.
    Its amazing how these banks can't even do simple calculations correctly..............

    It seems that some people have missed the bit about the small prints.
    I would definitely seek legal advice before you ask them to collect it, in case you end up having to pay their expenses.

    Why not just put the option to them that either they can pick it up or you can leave it with them if they cover your travel costs (i.e petrol and Bus/train fare home) Seems easy enough unless they are complete A-Holes.
