Will do, thanks bod1467! I am going to submit it online too but can I just clarify that I've ticked the right box - it is the one saying I am not liable for the parking charge isn't it??

Yep, that will do, but you could tick more if you want to, they're pretty meaningless to those who know their way around things (as you do now), but they can deter the naive, thinking that none applies to them, putting them off appealing.

One point on submitting it electronically, there have been some technical difficulties with using Firefox as the browser, with the POPLA code not being recognised, but Internet Explorer has been Ok.

Good luck with the appeal, come back and tell us when it's been upheld. Well done on all the research and work you've put in to developing your appeal. :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you to all that have helped me through this process, I have to admit it hasn't been easy! Fingers crossed for a positive result and I will of course be keeping you all updated. Once again THANK YOU!!!! :D
  • Hi all, just thought I'd quickly let you know what's happening so far with my appeal. Well.........nothing! Had an acknowledgement email on 04/11/2013 saying my appeal would be on 09/12/2013 which is only 10 days away but I've had nothing through the post from PE. Does this mean they have also not submitted anything to POPLA?

in my relatives case it came by email (either from popla or from the ppc, I believe it was the ppc`s defence sent to popla , so you should have received it if any defence had been put up, if they dont then you win by default I believe

in any case we are still waiting over a week later than the appeal date for our decision so clearly dont expect it in 11 days time , LOL :)

thanks, that may explain why my relative didnt manage to submit the actual popla appeal online, so sent it by snail mail , :)
  • Thanks for that - did you win the appeal?? Not really worried about when the appeal is just can't understand why I haven't received PE's defence yet! They're certainly cutting it fine!

already answered in post #15 (unknown at this time although its an Excel one)

checked the emails and popla sent the ppc defence out to my relative after receiving it from excel , this was 5 weeks before the appeal date
  • Well folks, the evidence pack arrived today.....all 52 pages of it! Most of it is photocopies of all previous correspondence and photographs of the signage in the car park. The last page though under the heading 'other evidence' is a signed witness statement! The only point they address in the documents is GPEOL. Not long to go now, just hoping for a positive outcome!
