    You say there was a fuel leak... Which likely involved repairing a fuel line or pipe or something... Loosing some fuel as part of this is to be expected!

    The pollen filter is a massively easy and inexpensive job - although should usually be completed as part of a service. But certainly not a massive problem.


    From what you've said it doesn't really sound like anything to worry about and the dealer sounds reputable so far - in fact I'd say they've gone well and beyond any legal obligations. You surely cannot expect more than this!!!
    A material fact........"Is a fact that is important, significant or essential to a person in deciding whether or not to engage or not to engage in a particular transaction, issue or matter at hand". So the fact that the car was previously used for driving lessons and would be significant in whether or not I bought the car, I would say was a material fact!!!!

    I would love to be in a position (as would many) to be able to buy a new car, but unfortunately I can't afford one!!

    As regards the fuel leak, I was told that it was just a few drops that had leaked, but as it was a diesel engine, that was why the smell was very strong. I would say that a quarter of a tank of fuel down after they had had the car overnight, it coming back filthy and covered in mud, having loose change taken from the car and finding long blonde hairs on the passenger seat, cause for complaint!!

    As regards the pollen filter...given the fact that the car was serviced by them in March 2013, and discovering by taking the car into another garage that the pollen filter had NEVER been changed, I don't think it is unreasonable to expect that I shouldn't have to pay to replace it, when it was meant to be done 7 months prior. The cost of it is not important!!

    Add to that the fact that the salesman told me point blank that the car was not previously used for driving lessons, and the fact that I do not have the service history book, but someone else's, I don't think i'm being unreasonable. Not to mention the fact that I have no insulation in the front of the car!!

    What I can expect,and what is the dealers legal obligation, is when buying a car, all the facts presented are accurate and truthful. And when a question is asked about the history of the car, the truth is forthcoming!!!

    It is even more than you say, a trader has to inform you of things like it being a driving school car, not wait for you to guess, as it would make a fundamental difference to your decision to buy.
