Another DSR

Options
Hiyas,

I bought a music keyboard recently but was not impressed by the quality of construction so I emailed the seller that I was returning the item under the DSR for the above reason.

Return postage costs were £68 because the item is heavy 12kg and expensive £2600, I returned it the day after I received it.

Can quality of construction be deemed as 'faulty' and so entitle me to a refund of the return postage?

No, quality is a subjective thing and not usually an indication of fault.

There is a possibility that you might have had a case for returning under the soga if the advert stated that it was high quality but in fact it wasn't ( but as neilmc stated, this is subjective), but since you have already informed the retailer that you were returning under the DSR's, this is really a moot point.

DSRs state a retailer is not allowed to deduct money (for return postage costs) where the consumer has the right to reject it. Ergo responsibility of the retailer.

Plus consumers can't lose their statutory rights, by waiver or otherwise.

But its all still going to come down to whether it is fit for purpose/of satisfactory quality, which as you've both said...is subjective.

I returned under DSR because at the time I assumed it was poor quality, It would be good if I could find out if it is built to normal standards or that it has been improperly constructed and is therefore faulty.

I think you have a case. I wouldn't be happy for a relatively expensive keyboard/digital workstation to be that flimsy (Mine is a Tyros which I love!)
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Quality of construction is one of the reasons why DSR exists, so you can inspect it in your own home and if your not happy send it back.

This however does not make it faulty, the vidoe clearly shows the issue you refer to but it has other comments on it from other buyers so it is a design and not a fault.

If you want to use the comfort of your own home to buy goods then you should at least know there is a rick of having to pay to return unwanted goods.

At the very least do your due dilligence on the product before you buy it, thats what google is for.
