data protection act

Hi,

Its the first time I have posted on here,

I stupidly about 2 years ago took out a greenwoods loan -(they knocked on my door asking if I want a loan while I was suffering a bout of depression and I tend to get credit when I'm down) Anyhow, I wasnt in today and the manager turned up and when my husband opened the door asked he explained that I wasnt in and can I pay over the phone like I usually do. The manager then started saying no I can't do that anymore and then told my husband all the details about my account. I may be wrong but I thought that under the data protection act-they are not allowed to talk to anyone other than the account holder about the account. He told him what I owe, (Im a couple of weeks behind) saying that its getting a big problem that needs sorting, and that I should be paying £40 a week and I am only paying £20 (I did that 1 week and made it up the next as arranged with my agent) to be honest its getting to the point that he is harassing me. My agent however is lovely its just this manager. - Another problem I have had with them is that I have been asking for a balance book so I can see where I am with my balance and payments. I still don't have one. I first asked a year ago!
Anyway, who would I go to about the revealing my account details to my husband (who knew the balance just not that I pay so much a month which is more than I need to so I can clear it off earlier)

  • Send their office a formal complaint, in writing about this. Then report them to the ICO.

    Also include about not receiving statements, which you are entitled to.

    Also complaint about feeling threatened by the manager and you now want all communication in writing only. Report them to the OFT if they continue to harass you.

    You presumably signed an agreement? Send them a CCA request in writing, they are obliged to include a statement of account as well as the copy of the CCA.

    Wow !! don't think this guy should be discussing this with anyone but you, I`ve had DCA`s do this to me, ringing work and discussing my personal business with my boss :eek: not nice, you could write and complain, also ask for your book while your at it, thing is whats said person to person cant be verified, he would most probably deny doing it !!

    That's shocking. Their own T&Cs say they will provide a book so that you can see what your balance is. Someone with better knowledge than me will help with this but I'd have thought they have broken their own contract . What if they come back to you and say you haven't paid anything at all, are you able to prove you have? Vice versa, what if you say you've paid it all off???

  • Nope I have some records from the bank accounts when I have paid over the phine. But when I pay cash they don't even give me a receipt which really bothers me. Wish I had been strong enough to say no when they knocked at the door!
  • the thing is my husband didnt even ask - he just started telling him. when my husband said -no problem Ill get her to ring you when she gets back.. He said well yes it is getting to be a problem! Apparently he was quite rude.
    Thank you all for replying glad I wasnt wrong in thinking that the manager had overstepped the mark.

    And personally, no receipt, no payment book would mean I wouldn't be paying another penny until it appeared in my hand. If they ever threaten court etc, they will get laughed out of court I would think.

  • thank you so much. you have all made me feel so much better about this. I shall write a letter of complaint to them tomorrow and to the ICO.
  • well I sent a complaint by email nearly a week ago haven't heard anything back about it at all. I have now since the stress from this now gone onto a DMP so it will be interesting what happens now. However it
    would be nice to get some acknowledgement about my complaint.
