Hey, can anyone please help?
I posted a while ago regarding an unfair pcn and was helped by many of you guys. I submitted an appeal to popla using the threads given to me but I have had a notice back from the parking company saying they are continuing the claim as no popla appeal has been made. I got in touch with popla and they have not received my letter and I am now out of the 28 day period.
Is there anything I can do?
Should I pay the fine or ignore it?
Please help
Martin

Would be better to stick to your original thread

DID you appeal to POPLA? Your other thread just says you have to appeal to POPLA - there's nothing to indicate you actually DID.0

Yes, I did appeal but they tell me they never received it0

Email or snail mail (with any proof of posting?)?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

It was sent by letter as I found it easier to write it that way. I never attained proof as I thought even royal mail couldn't screw up delivering a simple letter. I have learnt my lesson with that.

The only possible way of rolling this back to a POPLA appeal is if the Registered Keeper was not the driver. If that's the case then you need to write to PE to give the name and address of the driver.
Other than above, all you can now do is to try to ride this out, but you're likely to be getting Debt Collectors' letters and sooner, rather than later, a Letter Before Claim from PE.
So you now need to start reading here, and prepare yourself for some more work in tackling the LBC.

You don't have to pay if you're going to fight this, but it will be likely you'll eventually get court papers that you will need to produce a robust defence (POPLA-type points of challenge but more detailed, legal and technical in nature). Please note, we are not a legal advice forum. And go the complaint route to the Golf Club, as already covered umpteen times on all the other Tower Road threads. Personally I don't think you will get it cancelled but every complaint helps.
Search the parking forum for the keyword 'Newquay' or 'Tower' to find threads like yours talking about the Golf Club's ownership of the car park.

Right, I'm hoping this may be a lifeline here. I sent a letter to POPLA explaining that I had my first appeal lost in the mail and re-submitted my appeal which I have had a response from saying my case will be looked at in December. I hope PE can't fight this because the appeal was late.
I had the LBCCC I think from PE giving 14 days to pay. I was wondering what my next steps should be? Is it all ok now that POPLA are looking into it?
I had already been in touch with the golf club who had washed their hands of it, but the secretary had said that many people who had been in touch before, had ignored the letters and PE had given up.
I was wondering, if I have received the LBCCC, does that mean they will not give up and it will go to court?
Thanks for all your help guys, much appreciated.0 -

It means you need to check out the LBCCC fight-back sticky thread near the top of the forum. As part of your acknowledgement and response to the LBCCC you can attach a copy of POPLA's confirmation that they have received your appeal. Do not talk about it being 'lost in the post' as you don't know that! Could have been lost in the POPLA office and clearly POPLA have found it now!PRIVATE 'PCN'? I would just like to update on my situation. I have just received by response from POPLA and they have allowed my appeal. This is great news. I haven't planned to upload the full report unless people want it? Parking eye did respond to POPLA and the ground the appeal stood were down to no pre-estimation of loss. I hope this helps others who may wish to appeal on these grounds.
Thanks to everyone for their help, I never expected this and am delighted.
