    "The key features of the regulations are:

    * you must give consumers clear information including details of the goods or services offered, delivery arrangements and payment, the supplier's details and the consumer's cancellation right before they buy (known as prior information)
    * you must also provide this information in writing
    * the consumer has a cooling-off period of seven working days."

    Under section 10 you can only cancel in writing or a durable medium. So you need to send 3 a letter, fax or email. (I would use a fax or recorded/special delivery letter as then it cannot be argued that they didn't receive the notice.)

    BTW My 3 mobile phone sim is not stuck into the phone. I know because I had to put my handset together. Therefore your phone is not personalised to you but is personalised to the 3 network. In addition my contract specifically states if I used the phone before deciding to return it, I would be charge for my usage.
    I'm not cynical I'm realistic :p

    You could call them back and tell them the phone is faulty, say it keeps turning off and when it comes back on the screen has unreadable small text (they have a free repair service, you go into one of their stores and they send it off for you normally takes about three days).

    If it's a sony ericsson, try using the update service this normally freeze's the phone so it has to go back.

    Olly - Thankyou EVER so much! Tried everything else as my partner works in T-mobile and knows a huge amount, reading up on laws and drafting a letter now, really helpful!
