jury service

my husband has been summonsed for jury service, he starts monday. unfortunately he should of been home from work last week, however, due to weather conditions, he hasnt been able to get home. He is due home today, and a manager has just informed him he can not possibly come home before tuesday as he is needed at work.

where does he stand, as he has already accepted his jury service, having previously having it deferred. He has told the manager concerned he has jury service, they have said its fine they will give him a letter to hand in on wednesday??

Can this be allowed to happen, with such short notice?

He should have received a letter from the Jury Service team giving him the contact number of his Court jury officer. Just give him a call and explain what is happening - they just need to know.

thank you saker, i had visions of a warrant for his arrest for when he reached england on tuesday. :)
  • if he's been summonsed for jury duty then his manager has no say in it he HAS to go .
Taking a letter in on the Wednesday just means that his manager had him in work the extra couple of days you can't just wander into a trial half way through with a letter... it's not school and he's not telling the PE teacher that he can't go swimming as he's got a verruca. As Saker said, tell him to phone the court jury officer, they'll either say it's fine of he has to be there.

delaying jury duty is when you get the letter for jury duty and not delaying it at the last minute.

Did he tell his work in plenty of time that he was due to start Jury Service?

No one can stop him going and its not going to work with a letter to hand in as they will not accept that at all.

  • Sounds like the manager thinks he's more important than the judicial system

He told his immediate manager, but it wasnt booked in anywhere at work as he works on a rota, and he was on rota to be off work, when jury service takes place. he works two wks on three wks off, and jury service was too take place the last two wks off, unfortunately, we didnt think he would have too book the time off as it was during his time off, it was taking place.

When he was summonsed it quite clearly explains what actions you take. Please don't try and shift the blame to anyone else, if he is not physically able to attend, contact the court now. It is too late to wait until Wednesday to attend with a dodgy employers letter when he should be at the court, ready to act on Monday.

we are not shifting the blame to anyone!!! my husband has three wks off work, jury service was last two wks, he had no reason whatsoever, to believe a manager would refuse him the time off, considering, he shouldnt even be in work!!!!!

It was the "dodgy" employers letter, what made me query on this site.

So why is he, as he hasn't properly been excused from jury duty, planning to do extra work for his employer and turn up late at court? It's all in the guidance and grovelling with the Court Clerk today, a working day before jury service, might work, but don't expect it as a right.
