VCS John Lennon Airport.

A new user is claiming a court victory against VCS but has posted it in the Motoring section.

    "I have recently been to Court to fight a penalty charge issued by the money grabbing outfit Vehicle Control Services.

    I had an emergency on my way into the airport and stopped to investigate, unfortunately on a RED ROUTE. They rejected my appeal and invited me to appeal to POPLA, a waste of time, they are ineffective and their decisions are not legally binding but in the time that takes, the fine increases.

    VCS stated that they would not accept any further appeals but their letter head did give an 090 number to ring. 090 numbers are used for TV voting and the likes and cost between £1.65 from a land line and £2.55 from a mobile PER MINUTE. They produced lots of documents and photographs and sent a file to me and the court 14 days before the hearing.

    I was not looking forward to the hearing but I was going to defend myself by asking the simply question...are emergencies not allowed on red routes, do they not happen, or are they not supposed to happen? A vehicle with a puncture on a driving wheel will not drive because of the differential.

    However, it did not get to my speech, because, although they appeared mob handed with two people, the Judge, who was a no nonsense bright chap, told them that they had not produced their authority and or agreement with John Lennon Airport to the concerned parties within 28 of the hearing.
    They argued that it contained sensitive information but did have a copy with them. The Judge, threw the case out and awarded me costs.
    I offer this information not just because I very seriously dislike VCS and their methods and would very much like to see the detail of their agreement with JLA but because, if anyone else finds themselves in a similar situation, a precedent is now established.

    To some extent, I am sorry not to have been able to test the logic of my argument and if successful, would have derived much more satisfaction but in the end, I won , they lost. Bloody good result really.

    I am at work but can someone pm the poster and ask them to post here about it, in a reply on this thread that's already been started? And to cite the case number and which court and date? So that people can cite the decision.
