VCS Parking at Liverpool Airport

I have recently been to Court to fight a penalty charge issued by the money grabbing outfit Vehicle Control Services.
I had an emergency on my way into the airport and stopped to investigate, unfortunately on a RED ROUTE. They rejected my appeal and invited me to appeal to POPLA, a waste of time, they are ineffective and their decisions are not legally binding but in the time that takes, the fine increases.
VCS stated that they would not accept any further appeals but their letter head did give an 090 number to ring. 090 numbers are used for TV voting and the likes and cost between £1.65 from a land line and
£2.55 from a mobile PER MINUTE. They produced lots of documents and photographs and sent a file to me and the court 14 days before the hearing.
I was not looking forward to the hearing but I was going to defend myself by asking the simply question...are emergencies not allowed on red routes, do they not happen, or are they not supposed to happen? A vehicle with a puncture on a driving wheel will not drive because of the differential.
However, it did not get to my speech, because, although they appeared mob handed with two people, the Judge, who was a no nonsense bright chap, told them that they had not produced their authority and or agreement with John Lennon Airport to the concerned parties within 28 of the hearing. They argued that it contained sensitive information but did have a copy with them. The Judge, threw the case out and awarded me costs.
I offer this information not just because I very seriously dislike VCS and their methods and would very much like to see the detail of their agreement with JLA but because, if anyone else finds themselves in a similar situation, a precedent is now established.
To some extent, I am sorry not to have been able to test the logic of my argument and if successful, would have derived much more satisfaction but in the end, I won , they lost. Bloody good result really.

Small claims have also been successfully defended this month by forum posters against Excel, Civil Enforcement and ParkingEye (today!).

Please could you re-post your thread on the parking tickets forum instead so the parking ticket posters can see it?

Could you also post up the case number and which court, Judge's name and date of the case so I can add it here to the other successes people can then cite?

I pre booked a car parking space in the long stay car park for 3 weeks from30/12/13 and paid Holiday Extras just over £60.00 for the privilege of doing so. They directed me to a particular car park.

Arriving at the airport in the dark at 06.40 there were no car
parking spaces free apart from disabled. Several other cars were also looking for a space. I had to leave my car on a raised area with the bonnet into a bush and the 4 wheels of the vehicle overhanging a kerb. I would not have left my car in this situation unless I had an alternative. Other cars were parked in a similar way and if I "google map" the airport I can see other cars parked in these areas too.

Three weeks later on picking up the vehicle we had been issued with a PCN. £60.00 immediate payment or £100.00.
I have appealed the notice but this was rejected.

I have since written to Holiday Extras who had a contract with me to provide me with a secure car parking space. They have also rejected my appeal stating "there were 650 car parking spaces available on the day I parked my car"

I have since re written to Holiday Extras but have not yet appealed to Popla.

I'm too busy to do all this!!!!! Any suggestions or experience of others would be helpful.

Cordero - you need to post a thread in the parking tickets board but be aware the "I'm too busy" line is not likely to get you any sympathy. There are ways to avoid paying but it WILL take some time and effort on your part, if you're not willing to put this in you may as well just pay this now before it goes any further.

The best thing you could do is start your own thread in the Parking Tickets Forum and read the Newbies sticky, which lays-it out very well indeed:

Hijacking someone else's thread in the wrong forum will only make your task a lot more complicated as you won't get individual advice.
