Has estate agent stolen my money?

Hi,

I viewed a rental property earlier this week and made an offer that the landlord accepted via the estate agency. I was then asked to complete an application form and the usual checks would be carried out.

The application form stated that I needed to not be in a probation period with my employer, unfortunately I've recently started and my probation is until December. I returned to the agents and advised them that until I have made a decision on whether to pay rent up front or a guarantor, to not take any action. They previously took my debit card details and this morning have debited £200 (the application fee).

I gave them no authority to do this and didn't actually apply for the property. Are they able to do this? I'd have expected the £200 to be debited upon my application being submitted (whether successful or not) and not before I have even applied? Any help please?

    Do you still want the property?
    It might be a holding fee.
  • What did you give them your debit card number for if not to pay for the application fee etc?

    At the end of the day it sounds like a timing issue
  • I have talked to them, just thought someone here might know more than me on the legalities of this situation, whilst they 'look into it.'

    I don't want the property because their terms and conditions, which were not explained to me prior to this situation occurring, don't allow me to. It essentially seems they have taken the fee for an application when I haven't made a formal application.

    Did you fill out and return the application form? If you did, it would be pretty easy to take that as an application.
