Better to sell house as 1 property or split into 2 flats?

    Initially, it may be prudent to just ask the council for details of the planning history of the house... rather than specifically saying it's been split into 2 flats, and was consent ever granted. Otherwise, the planning enforcement team may take an interest, and you may be forced down the 'certificate of lawfulness' route more quickly than you would have liked.

    If there is no consent, you should think about gathering evidence that shows the building has been used as 2 flats for at least 10 years. (I think 10 years would the time limit for enforcement in this case - as it is 2 dwellings.)

    Good point, I'm not sure the Council will have any details of the planning history of the house as the conversion was done back in the 1960s and think i remember enquiring with them once some yrs ago. It's been used as 2 flats for over40yrs so hopefully i can dig up some evidence there!
