Recent split with long term gf, mortgage help??

Morning,

I currently own a flat with my now ex-girlfriend of 4 years. We're both on the mortgage and deeds, so legally we have a 50% share of the property.

In early May she decided that the relationship was over and I moved back to my parents.

I'm currentely paying my share of the mortgage and all the bills even though i'm not living there. - Do you think I should, or do I have a right to say that i'll just pay my share (50%) of the mortgage?

Any help would be greatly appreciated. Going to a solicitor is the last resort too, as I/we are trying to be as amicable as possible.

    Sorry to hear of your situation, it seems fairly simple (taking the emotion out of the equation.)

    There are a couple of options:
    She buys your half of the property & changes the deeds etc to reflect this.
    Sell the property, repay the morgage & split 50/50 the profits (if any)

    If in doubt, seek advice from CAB. It's free and less aggressive than solicitors.

    If you wish to keep the poperty as an investment and your ex agrees that this is ok, then I would have thought that the fair thing to do would be to continue to pay your half of the mortgage and half any standing charges on the bills. I wouldn't pay the whole bills as it is not you using the electric water etc.

    If it were me, I'd just be paying half the mortgage on the understanding that its going to be sold and the equity divided. The mortgage is a debt which you are liable for and therefore have to pay. But the bills, well your not living there so why should you pay. I can see Arthur's argument regarding the standing charges so maybe to remain amicable that is a good compromise.

    How many bedrooms in the flat? If it's got 2, then the 2nd one can be rented out to cover your mortgage half. This is the agreement me and my OH have if we ever split up.

    If your OH is living there, then SHE should be paying the bills, not you! At the very most you should pay half, but not more. You need to discuss this with her. Keep paying your half of the mortgage though.

  • If you hadn't had the flat together, and you split, would you have wanted to have a continuing financuial relationship with her? On the basis that the answer is no, get rid of your interest in the flat. You should never have old emotional ties to an investment, as these can cloud your judgement.

    Shes paying for the place she lives in. You're paying for the place you live in plus somewhere else! Who has the better deal?

    Get a good solicitor, Mine started amicable, and like a fool I believed her lies, 2 years, 2 court appearances and a large legal bill later, I AM FREE!!!!!!!!!!!
