Hi

I've just received a letter from TPS saying they are issuing a Notice Charge fee for over saying by 12 minutes & 49 seconds in the Winsford Multi-Story Carpark owned by ASDA which gives 3hrs of free parking.

The only reason the driver was late was being stuck in a queue in ASDA doing the weekly shop spent over £80 on shopping now have a letter asking for £50 or £30 if paid within 14 days.

I've just spent the last few hours reading the posts on this forum, and I'm unclear what to do next.

There have been a lot off issues with the parking charges on this car park from last December it was in the local paper, but I'm just wondering now how many others like me have had a letter and but they have just paid the £30 charge.

So I'm asking for help do I just pay the £30 and be done with it or what?

Of course you don't pay them!

If you can see those links then you can see how to send a challenge as the registered keeper, and how to complain (and how to win at POPLA in the end).

1 COMPLAIN to ASDA about being penalised and harassed for committing the 'crime' of taking too long to spend YOUR money in THEIR store and ask what you should do next time there are long queues at the till? Abandin your shopping trolley and race to the car so you can leave the car park in time? - see this thread. Enclose copies of receipts or redacted card statement if you have them

2 APPEAL to TPS in the following format:

I am the registered keeper of vehicle reg xxxx and am writing to appeal against PCN number xxxx concerning an alleged parking event at [location] on [date].

The driver on that day .... then explain what happened refering to 'the driver' in the third person. Point out that the driver was a genuine customer and also remind TPS of its obligation under the BPA code of practice to provide a grace period and that surely 12 minutes comes within that description especially on such a busy day. Again enclose copies of proof of purchase. Tell them that you expect them to cancel the charge on this occasion but if they refuse to do so then they must give you a POPLA code so you can appeal to POPLA where you are confident that your appeal will be upheld.

3 put some key words into the search box - 'asda' 'tps' and do some reading.

4 Coupon-mad has some useful links - I am sure she will be along soon.

  • Thanks for the replies

I've just tried to speak to the Asda manager Ruth Houghton and I was told she's in a meeting all day. Does anyone have an email address so I can complain to her or should I write a letter instead?

I'm just in the process of sending TPS a letter appealing against this charge now should I write this or email?

Thanks again for the quick replies I really appreciate it.

If you still do your weekly shop there I'd stand at the CS desk next time you are there and demand to see a manager - there is no way that a shop floor manager is not available for the whole day. don't leave until they say they'll get it cancelled
  • I'd rather not make a seen in store if I can help it as I have family/friends who work their, and I don't want them to get a backlash from this. I know this shouldn't happen, but we all know it does...

Depends on how they accept appeals, as per the ticket. Either would do.

And just try ringing the Store Manager every day this week until she is 'free' to cancel this offensive ticket.

Eh? You may have seem a lot of varying advice in reading all the posts, but do any of them advise paying? I don't think so.
