I have to back up Stroma here. Very many parking tickets can be disputed on technicalities/errors in procedure.

Having said that I don't think I would park there as I can see what the signage and double yellows are trying to indicate.

Whether everything is 100% in accordance with the regulations remains to be seen.

But I think that the argument that parking is permitted is a loser.

The alleged contravention is 62 not 01, so the DYL are completely irrelevant.
Sorry, I have looked through this thread and see no mention by the OP of the actual offence code or sufficient description to identify the code.

Please indicate where this info is.

That's assuming it is the authorities, I've learnt from advising on parking for a while that you shouldn't assume anything! And judging someone should be left to those who has the qualifications and possession of all the facts. I'm not having a go at you, but we are here to advise not to judge people.
I didn't assume anything. I used the words "It is possible..." and "Perhaps...".

I commented on my interpretation of what I could see in the photo and, in my opinion, the OP is clearly in the wrong and probably has no grounds to appeal.

I don't see that as "judging him" in the sense that you appear to suggest.

He may find he can appeal on some technicality but frankly I think he is lucky to have got away with this for five years. I see it as selfish and inconsiderate parking.

There, that is me judging him. :D

Trying to work out why you have been singled out, I think the following could apply.

Making the assumption that this is a public road and not private and that, if I can use the term, it is in all ways "normal", then from the picture you are parked on one side of a double yellow line that has a termination bar.

It is my belief - and I could be mistaken - that the double yellow covers both the road and pavement side. We have recently had discussion on this point on another thread. In fact, take a look at the highway code here http://www.direct.gov.uk/prod_consum_dg/groups/dg_digitalassets/@dg/@en/documents/digitalasset/dg_070563.pdf It says "waiting restrictions apply to carriageways, pavements and verges" . And, of course, the Highway Code has other wise words about parking near to a junction.

The double yellow lines in your picture cover the corner junction and seem sensible. They cease just behind your car, so that is why you have been ticketed, I think, and others have not. .

I would guess that they are a safety feature and that the comment by Avoriaz in his first post on that matter seems reasonable.

Stroma make the point that we are here to advise not judge. Well, my advice is to park elsewhere as I can see why you may have been ticketed and if you continue to park there, you can look forward to lots more. I would also ask you to look objectively at whether or not you could be obstructing people'e view of the corner and if there is a slight chance that it could contribute to an accident, then don't park there.

    Have a look here http://www.publications.parliament.uk/pa/cm201314/cmselect/cmtran/writev/parking/m01.htm

Having said all that, councils make so many mistakes on their tickets that it is always worth appealing. The real experts on tickets etc are on pepipoo.com so you should try there.
  • Yes, it is from the council.

I was surprised that it happened for the first time in 5 years. It seems they are clamping down on it now, even though everyone else continues to park there, perhaps because the pavement is quite wide from all sides so if you park the car more into the pavement you do not end up obstructing vision or the pedestrians.

In any case, if I have to pay the fine (so I assume reading most of the comments), can I at least get the council to cancel one of them since they were both issued within a space of a couple of days, and arrived through the post together?

    Thanks

Try pepipoo, as I said, Mark. They are loophole experts. Good luck.

Well, I park the car as far back as possible, so only half the car is parallel to double yellow lines, but I doubt it matters.

As far as I can see from the picture, there are no yellow lines on the road apart from the double yellows at the corner.

Could you not have parked on the road itself or did you think, ironically as it transpires, that it caused less obstruction or was safer to park on the pavement?

I concur try https://www.pepipoo.com for this, they will advise you on the merits of what you say, and not judge you on this.

Sometimes I despair with this forum!!
